The subject of the contract is the successive purchase and successive delivery of diesel fuel for the needs of vehicles and machines of the Ordering Party - Miejskie Przedsiębiorstwo Gospodarki Komunalnej Sp. z o.o. and the Choszczno Municipality.
Deliveries will take place to two tanks (separate for each Ordering Party) located on the premises of the Environmental Protection Plant, in Choszczno, at 60 Wolności Street.
The Ordering Party estimates that the order will include:
- 134 000 liters (134 m3) for the needs of MPGK Sp. z o.o. and
- 46 000 liters (46 m3) for the needs of the Choszczno Municipality.
Estimated order volume: 180,000 liters (180 m3)
Individual deliveries will be carried out within 48 hours from the moment of placing the order by the Ordering Party, whereby the order will be forwarded in electronic form or through a free dedicated portal of the Contractor. Orders will be transferred in the above-mentioned manner separately by Miejskie Przedsiębiorstwo Gospodarki Komunalnej Sp. z o.o. and by the Choszczno Municipality. The Contracting Authority also allows the transfer of orders via the Contractor's purchasing portal, if the Contractor will have one to handle the execution of orders. In particularly justified cases, at the request of the Contractor, with the consent of the Ordering Party, the delivery may be carried out within a longer period than specified above, but for the maximum period of individual delivery may not exceed 72 h. Deliveries of diesel fuel will be carried out in quantities depending on the current needs of the Ordering Party. The one-time delivery volume is approx. 4,000 l (4 m3). The offered fuel must meet the requirements set out in the Regulation of the Minister of Economy
of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680), the required parameters are specified in the table constituting Annex 3 to the above Regulation. Deliveries will take place in a tank truck for the transport of diesel fuel of the Contractor, equipped with a pump enabling filling of the Ordering Party's ground tank. With each delivery, the Supplier is obliged to provide proof of WZ confirming the quantity of fuel delivered and a certificate of quality of the delivered fuel batch.
11. The quantity of fuel referred to in paragraph 4 shall be an estimated (forecast) quantity, has been determined as an element for the selection of the most advantageous tender and does not constitute an obligation on the part of the contracting authority to purchase fuel in the quantities indicated. The Contractor shall not be entitled to any claims for reducing or increasing the quantity of oil ordered. The Ordering Party provides that changes in the amount of fuel purchased may amount to up to 20%. The Ordering Party reserves the right to check the compliance of the quality parameters of the supplied fuel with the delivered quality certificate. Tests of samples of supplied diesel fuel will take place in accredited laboratories selected by the Ordering Party. The cost of laboratory tests shall be borne by the Ordering Party, and in the event that the results of laboratory tests show non-compliance with the quality certificate, the cost of the test shall be borne by the Contractor. Such delivery is then subject to complaint. The Ordering Party shall take into account the discrepancy between the presented quality certificate at delivery and the results of laboratory tests of samples of delivered diesel fuel within the limits of differences acceptable by test methods, in accordance with the applicable PN-EN ISO 4259 standard. Fuel deliveries will take place on the basis of an agreement concluded with the Contractor, the proposed provisions of which are included in Appendix No. 5 to the SWZ.
