Description:
Reception and transport of municipal waste from residential and public places from Suwałki Municipality

The subject of the order is the collection and transport of municipal waste from inhabited and public places from Suwałki Municipality.

3.1. The subject of the order is the collection and transport of municipal waste from inhabited and public places from Suwałki Municipality.

3.2. A detailed description of the subject of the contract is specified in Appendix No. 2 to the SWZ.

3.3. The Ordering Party does not allow the submission of partial offers. Division into parts would result in excessive costs of contract performance and serious difficulties in coordinating the activities of different Contractors, which would result in improper performance of the contract. The contract shall be awarded in parts, each of which shall be the subject of a separate procedure.

3.4. The quality requirements referred to in Article 246(2) of the PPL Act have been described in detail by the Ordering Party in the description of the subject of the contract and annexes to the SWZ.

3.5. Pursuant to Article 95(1) of the PPL, the Contracting Authority requires that the Contractor or Subcontractor(s) employ on the basis of an employment contract within the meaning of Article 22 § 1 of the Act of 26 June 1974 - Labour Code (i.e. Journal of Laws of 2023, item 1465, as amended) all persons who will perform activities during the performance of the contract

as regards the execution of the contract, if the performance of these activities consists in the performance of the work in the manner laid down in Article 22 (1) of the Act of 26 June 1974. The Code of Work under the direction of another person, at the place and time indicated by that Contractor or Subcontractor - consisting of:

1) driving specialised vehicles intended for the collection of waste (drivers);

2) loading of waste (loaders);

3) the organization and logistics of the collection of municipal waste (administration staff).

The employment referred to in above should continue throughout the period of the execution of the contract.

The requirements regarding the method of documenting the employment of persons referred to in Article 95(1) of the PPL Act, the Contracting Authority's powers to control the contractor's compliance with the requirements referred to in Article 95(1) of the PPL Act, and sanctions for failure to meet these requirements, are specified in detail in the Draft Agreement constituting Annex 8 to this SWZ.
