1. The subject of the order is the gradual delivery of drugs authorized for marketing in the Republic of Poland, with valid Registration Certificates, in the quantity and assortment specified in the price form of this specification (Annex 2 to the ToR), having an expiry date of not less than 6 months from the date delivery to the Employer.

2. The drugs subject to this contract have established quality standards. These standards were established for each drug during its registration and are the same for the chemical substances they contain. Drugs for their use do not require any distinctive elements within the individual substances. In addition, each drug traded in the Republic of Poland must be registered in the Office for Registration of Medicinal Products, Medical Devices and Biocidal Products. The Employer will request from the selected Contractor for the first delivery the characteristics of medicinal products specified in the Price Form (preferred form - CD carrier). The price form for the selected offer will be attached to the contract.

3. A detailed description of the subject of the contract is specified in the Price Form, which is Annex 2 to the ToR.

4. The Contractor is obliged to perform the contract on the terms and conditions described in the contract template constituting Annex 3 to the ToR.

5. Common Procurement Vocabulary CPV: 33600000-6 - Pharmaceutical Products.

6. The Awarding Entity allows submission of equivalent offers - equivalents or substitutes for a given item on the price form, provided that the same properties are guaranteed.

7. The Purchaser divided the subject of the contract into 34 lots (packages) and allows the submission of partial bids, however for the whole package. Individual packages must be priced the full range in the quantities provided by the Employer. The Purchaser agrees to submit an offer with a different number of items in the package than specified in the ToR using the conversion of the packages to 2 decimal places, except for the exceptions indicated in the Price Form, constituting Annex 2 to the ToR.

The contractor may submit an offer for any number of packages.

8. The Purchaser does not allow the submission of variants.

9. The Awarding Entity does not provide for the possibility of awarding contracts referred to in art. 67 section 1 point 7.

10. Object of the contract The Contractor shall deliver at the Customer's own cost and risk to the Employer's Pharmacy.

11. Deliveries will take place successively, in accordance with partial orders, specifying the range and quantity each time, within the time limit specified by the Employer.

12. The Awarding Entity allows the participation of subcontractors. The Employer requests an indication by the Contractor

The offer includes a part of the order which it will entrust to subcontractors.
