SERVICING IN THE YEARS 2023-2026 AIRCRAFT GROUND HANDLING EQUIPMENT (NOSP) OF WESTERN PRODUCTION<

The subject of the contract is the provision in the years 2023 ÷ 2026 to the military units of the Polish Armed Forces indicated in Annex 8 to the Draft provisions of the agreement being Annex 1 to the SWZ, hereinafter referred to as the User, of services including maintenance of aircraft ground handling equipment (NOSP) of western production specified in Annex 2 to the Draft provisions of the contract, i.e.: performing repairs (improvements), maintenance work, implementation of technical bulletins, provision of technical assistance (engineering support) and metrological control, including the supply or replacement of technical means of materials (TM), if necessary to maintain the efficiency of aviation equipment. Services should be performed in accordance with the technical documentation of equipment manufacturers indicated in Annex 2 to the Proposed provisions of the Agreement, and persons indicated in Annex 11 to the Proposed provisions of the Agreement performing maintenance activities subject to the contract should have the rights of equipment manufacturers to perform the service.
2. The Contractor shall provide a guarantee confirming the performance of the service in accordance with the rules set out in the technical documentation, but not less than:
- 12 months or 200 hours of work (whichever elapses earlier) for new TMMs built on aviation technology equipment;
- 6 months or 100 hours of work (whichever comes first) for used TMMs built on aviation technology equipment;
- 6 months for the work performed, but no longer than until similar work is performed on aviation technology equipment by the User or until similar work had to be performed due to reasons in operation.
The warranty period is calculated from the moment of receipt of the service/equipment or tśm by the User.
3. If technical activities in the scope of contract performance (including m.in assembly and disassembly of equipment, equipment inspections, transport of equipment and its components, equipment repairs) consist in performing work in the manner specified in Article 22 of the Act of 26 June 1974 – Labor Code (Journal of Laws of 2022, item 1510, as amended), persons performing the activities in question, should be employed by the Contractor/subcontractor on the basis of an employment contract.
4. The contracting authority does not provide for the exercise of the right of option.
5. Detailed terms of the contract are set out in the Draft provisions of the contract constituting Annex 1 to the SWZ.
6. Pursuant to Article 455 of the PPL, the contracting authority allows for the possibility of amending the contract without conducting a new procurement procedure in the cases and under the conditions specified in § 17 of the Draft Agreement Provisions constituting Annex 1 to SWZ.
7. The subject of the contract will be subject to quality acceptance by the District Military Representation in the scope and on the terms described in § 6
Draft provisions of the contract constituting Annex 1 to SWZ.
8. The Contracting Authority requests that the offer be accompanied by the said means of evidence indicated in Chapter IV of the SWZ, confirming that the Contractor has access to technical documentation developed by the manufacturer of equipment for servicing and repairing equipment and its assemblies, subassemblies and elements.
Services should be conducted in accordance with the maintenance technology developed by the equipment manufacturer.
9. The terms of the contract are specified in the Draft provisions of the contract constituting Annex 1 to the SWZ.
10. The award of the contract does not involve making classified information available to the Contractor.
