The subject of the Order is:
Supply of medical equipment:
Rump. 1 – Tool tray, tool basket
Rump. 2 – ENT endoscopic optics
The contracting authority allows partial bids.
Parts of the order are the individual tasks specified above, i.e. tasks 1 to 2.
The Contracting Authority informs that the Contractor may submit a bid up to 2 tasks (without limiting the number of tasks per Contractor)
A detailed description of the subject of the contract is included in Annexes 2b and 5 to the SWZ.
Rump. 1 – Tool tray, tool basket3.3. Requirements of the Ordering Party for the object of the order
1) the medical device offered must have attestations, certificates and be registered in accordance with legal regulations requiring possession of attestations, certificates and registration,
2) the medical device offered must be placed on the market and used in accordance with
with the requirements of the Act of 7 April 2022 on medical devices (Journal of Laws of 2022, item 974),
3) the medical device offered must comply with the standards or technical specifications applicable to that device;
In the event that the offered medical device does not require notification to the President of the Office for Registration of Medicinal Products, Medical Devices and Biocidal Products, the Contractor is obliged to perform all activities at its own expense and on its own
necessary to comply with all legal requirements related to the marketing and use of the product in the Republic of Poland. The Contractor is obliged to perform such activities within the deadlines resulting from the applicable regulations and to provide the Contracting Authority with relevant documents confirming the performance of such activities within these deadlines.
3.4. In cases where trademarks, patents or origin, source or specific process that characterizes certain products or services provided by a particular contractor are indicated in the description of the subject of the contract, this means that the Contracting Authority cannot describe the subject of the contract in sufficiently precise and understandable, however, in any such situation the Contracting Authority allows a solution equivalent to those described in the above. In such situations, possible indications for trademarks, patents, origin, source or specific process that characterizes certain products or services provided by a particular contractor shall be read together with the words “or equivalent”.
When describing the subject of the contract by reference to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 (1) (2) and (3), the Contracting Authority shall allow solutions equivalent to those described In such situations, the possible indications should be read together with the words “or equivalent”.
3.5. The Contracting Authority shall require the execution of the object of the contract under the terms specified in the The designed provisions of the public procurement agreement to be entered into the contract are annexes to the SWZ.
20. INFORMATION ON THE ANTICIPATED CONTRACTS REFERRED TO IN ARTICLE 214
PARAGRAPH 1, POINTS 7 AND 8, WHERE THE CONTRACTING AUTHORITY PROVIDES FOR THE AWARD OF SUCH CONTRACTS
The Contracting Authority shall not provide for the award of contracts referred to in Article 214 (1) (7) of the Law Pzp.
The Contracting Authority shall not provide for the award of contracts referred to in Article 214 (1) (8) of the Law Pzp.
13. A DESCRIPTION OF THE CRITERIA TO BE GUIDED BY THE CONTRACTING AUTHORITY WHEN SELECTING THE TENDER, INCLUDING THE WEIGHTING OF THOSE CRITERIA AND HOW TO ASSESS THE TENDERS
13.1. The evaluation of tenders will be carried out on the basis of the criteria set out in the SWZ and their weights.
Offers will be assessed separately for individual Tasks.
During the evaluation of the offers, the subsequent considered and evaluated offers are awarded points for the following criteria according to the following rules:
