1. The subject of the contract is to improve air quality through the installation of RES installations in households from the area of the Municipality of Mielec divided into 4 parts:
1) part I - photovoltaic installations,
2) part II - solar collectors,
3) part III - heat pumps,
4) part IV - biomass boilers
2. A detailed description of the subject of the contract is contained in Volume III of the SWZ.
3. The essential conditions for the performance of the contract are also specified in the model contracts for each of the parts of the contract contained in Volume II of the SWZ.
4. Due to the limitations of the number of characters in individual sections of the announcement, the Ordering Party, where the number of characters prevents the conclusion of the full content of individual terms of the contract, refers to the content of the specification of the terms of the contract.
5. The Ordering Party shall allow the possibility of submitting partial tenders. The Contractor may submit a tender for the entire contract specified in this SWZ or for any part(s) of this contract. The evaluation of the tenders will take place separately for each lot.
Part I – covering the delivery, installation and commissioning of photovoltaic installations in households from the Mielec Municipal Municipality1. The subject of the contract under Part I is the preparation of design documentation (a separate project for each object) along with the author's supervision over the implementation of assembly works, delivery of equipment, execution of construction and assembly works, commissioning and carrying out the procedure of incorporating photovoltaic microinstallations into the DSO network along with conducting instructions for users of facilities in the field of installation operation and servicing of installations during the warranty and warranty period. Installations with a total capacity of at least 1 566.18 kWp (1.56618 MWe) will be located on private properties belonging to residents of the Municipality of Mielec – a total of 422 objects:
- with a minimum power of 2.31 kWp – 58 installations,
- with a minimum power of 3.30 kWp – 189 installations,
- with a minimum power of 4.62 kWp – 175 pieces of installation,
2. A detailed description of the subject of the contract is contained in Volume III of the SWZ. The essential conditions for the execution of the contract are also specified in the model contracts for each of the parts of the contract contained in Volume II of the SWZ.
3. The Contracting Authority shall allow the performance of the contract with the participation of subcontractors. The Ordering Party requests that the Contractor indicate in the offer (in the "Offer" Form) the part of the contract whose performance the Contractor will entrust to subcontractors and provide the subcontractors' companies and the value or percentage of deliveries carried out by a given subcontractor.
4. The selection of the most advantageous offer will be determined by the following criteria: Price 60%, temperature coefficient Pmax of the photovoltaic module 20%, number of free inspections of photovoltaic installations (except for inspections required by the manufacturer) - 20%.
5. The Contractor is obliged to submit together with the offer the following means of proof, confirming that the offered deliveries meet the requirements as to the subject of the contract specified by the Ordering Party:
- a data sheet signed by the manufacturer and/or a declaration by the manufacturer; to demonstrate compliance with the minimum parameters provided for photovoltaic panels (modules), described in the document "Guidelines for Contractors" (Chapter III of the SWZ, Annex 1), in Table 2 (rows 1 to 14, excluding the flash test). The means of proof indicated relates to the criteria for the evaluation of tenders and is not subject to supplementation;
- a data sheet signed by the manufacturer and/or the Manufacturer's declaration to demonstrate compliance with the minimum parameters provided for a hybrid inverter (inverter) described in the document "Guidelines for Contractors" (Chapter III SWZ, Annex 1), in Table 3 (rows 1 to 10);
- a data sheet signed by the manufacturer and/or the Manufacturer's declaration to demonstrate compliance with the minimum parameters provided for a non-hybrid inverter (inverter) described in the document "Guidelines for Contractors" (Chapter III SWZ, Annex 1), in Table 3 (rows 1 to 10).
6. Information on the protection of personal data resulting from Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 in spr. the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC, including the obligations and powers, are described in Chapter I of the SWZ (IDW) in Section II.
7. Pursuant to Article 95(1) of the Public Procurement Law, the Contracting Authority shall require the Contractor, subcontractor or further subcontractor to employ persons performing the works covered by the subject of the contract indicated in the description of the subject of the contract, including physical work, if the performance of these activities consists in performing work within the meaning of the provisions of the Act of 26 June 1974 Labour Code.
Part II – covering the delivery, installation and commissioning of solar collectors in households from the Mielec Municipality1. The subject of the contract under Part II is the preparation of design documentation (a separate project for each object) along with the author's supervision over the implementation of assembly works, construction and assembly works, delivery of equipment, commissioning of the installation of solar collectors along with instruction for users of facilities in the field of installation operation and servicing of the installation during the warranty and warranty period. Installations with a total capacity of at least 289.98 kW (0.28998 MWe) will be located on private properties belonging to residents of the Mielec Municipal Municipality – a total of 67 facilities:
- number of collector plates – 2 pieces – 25 pieces of installation,
- number of collector plates – 3 pieces – 39 pieces of installation,
- number of collector plates – 4 pieces – 3 pieces of installation,

5. The Contractor is obliged to submit together with the offer the following means of proof, confirming that the offered deliveries meet the requirements as to the subject of the contract specified by the Ordering Party:
a data sheet signed by the manufacturer and/or the Manufacturer's declaration to demonstrate compliance with the minimum parameters provided for the solar collector, described in the document "Guidelines for Contractors" (Chapter III of the SWZ, Annex 2), in Table 4 (rows 1 to 12);
- a data sheet signed by the manufacturer and/or the Manufacturer's declaration to demonstrate compliance with the minimum parameters provided for the tank for the installation of solar collectors, described in the document "Guidelines for Contractors" (Chapter III OF THE SWZ, Annex 2), in Table 3 (rows 1 to 10).
6. Information on the protection of personal data resulting from Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 in spr. the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC, including the obligations and powers, are described in Chapter I of the SWZ (IDW) in Section II.
7. Pursuant to Article 95(1) of the Public Procurement Law, the Contracting Authority shall require the Contractor, subcontractor or further subcontractor to employ persons performing the works covered by the subject of the contract indicated in the description of the subject of the contract, including physical work, if the performance of these activities consists in performing work within the meaning of the provisions of the Act of 26 June 1974 Labour Code.
Part III – covering the supply, installation and commissioning of heating pumps in households from the Mielec Municipal Municipality1. The subject of the contract under Part III shall be:
a) preparation of design documentation (a separate project for each object) along with the author's supervision over the implementation of assembly works, execution of construction and assembly works, delivery of equipment and commissioning of heat pump installations for DHW along with instruction for users of facilities in the field of installation operation and servicing of installations during the warranty and warranty period. Installations with a total of 60 pcs. and a total capacity of 120.00 kW (0.120 MWe) will be located on the properties of residents of the Mielec Municipal Municipality – a total of 60 facilities;
b) preparation of design documentation (a separate project for each object) along with the author's supervision over the implementation of assembly works, execution of construction and assembly works, delivery of equipment and commissioning of heat pump installations for central heating together with DHW along with instruction for users of facilities in the field of installation operation and servicing of installations during the warranty and warranty period. Installations with a total capacity of at least 529 kW (0.529 MWe) will be located on private properties belonging to residents of the Mielec Municipality – a total of 28 facilities:
- with a minimum power of 12 kW – 9 pieces of installation,
- with a minimum power of 19 kW – 9 pieces of installation,
- with a minimum power of 25 kW – 10 pieces of installation,

4. The selection of the most advantageous offer will be determined by the following criteria: Price - 60%, COP in the central heating pump together with DHW at A7W35 - 20%, the number of free inspections of the heat pump installation (except for inspections required by the manufacturer) - 20%.
5. The Contractor is obliged to submit together with the offer the following means of proof, confirming that the offered deliveries meet the requirements as to the subject of the contract specified by the Ordering Party:
- a data sheet signed by the manufacturer and/or a declaration by the manufacturer; to demonstrate compliance with the minimum parameters provided for the DHW pump, described in the document "Guidelines for Contractors" (Chapter III of the SWZ, Annex 3), in Chapter I.2.5.3, in points 1 to 17;
- a data sheet signed by the manufacturer and/or a declaration by the manufacturer; in order to demonstrate compliance with the minimum parameters provided for the central heating pump together with DHW, described in the document "Guidelines for Contractors" (Chapter III of the SWZ, Annex 3), in Chapter I.2.5.3, in points 1 to 18. That measure of inquiry relates to the criteria for the evaluation of tenders and is not subject to supplementation.

Part IV – covering the delivery, installation and commissioning of heating boilers in households from the Area of the Municipal Municipality of Mielec1. The subject of the contract under Part IV is the preparation of design documentation (a separate project for each object) together with the author's supervision over the implementation of assembly works, execution of construction and assembly works, delivery of equipment and commissioning of biomass boiler installations along with instruction for users of facilities in the field of installation operation and servicing of installations during the warranty and warranty period. Installations with a total capacity of at least 178 kW (0.178 MWe) will be located on private properties belonging to residents of the Mielec Municipal Municipality – a total of 9 facilities:
- with a minimum power of 12 kW – 1 piece of installation,
- with a minimum power of 20 kW – 7 pieces of installation,
- with a minimum power of 26 kW - 1 piece of installation.

- a data sheet signed by the manufacturer and/or a declaration by the manufacturer; in order to demonstrate compliance with the minimum parameters provided for a biomass boiler, described in the document "Guidelines for Contractors" (Chapter III OF THE SWZ, Annex No. 4), in Chapter I.2.5.3, in subsection (a) Boiler. That measure of inquiry relates to the criteria for the evaluation of tenders and is not subject to supplementation.
