The subject of this contract is the purchase of electricity for the facilities indicated in Annex 1 to THE SWZ, in accordance with the provisions of the Act of 10 April 1997. The subject of this order is the purchase of electricity for the facilities indicated in Annex 1 to SWZ in accordance with the provisions of the Act of 10 April 1997. Energy law, Civil Code and implementing regulations issued pursuant to them.

The Municipality of Skarżysko-Kamienna and the Members of the Purchasing Group as well as their units listed in Annex 1 to the SWZ will conclude separate contracts from this public procurement procedure under the unlimited tender procedure for the PURCHASE OF ELECTRICITY FOR THE NEEDS OF THE PURCHASING GROUP OF THE MUNICIPALITY OF SKARŻYSKO-KAMIENNA. Detailed information on the conclusion of contracts by the Commune and its organizational units is included in Annex 1 to SWZ. It will be the duty of the selected Contractor to represent the Ordering Party and its organizational units before the appropriate Distribution System Operator in matters related to the notification of a change of seller. To perform the above-mentioned activities, the Contractor will receive an appropriate power of attorney (Annex No. 4.1 to SWZ)

The Contracting Authority shall act on his own behalf and on the basis of a signed agreement (agreement for inspection at the premises of the Contracting Authority), on behalf of:

Order — purchase of electricity for the facilities listed in Annex 1 to SWZ:

The estimated electricity demand in the period from 01.01.2023 to 31.12.2023 is 10 573 417.00 kWh.

The estimated value of the contract in the period from 01.01.2023 to 31.12.2023 is PLN 8,339,259.59.

The performance of the activities arising from the power of attorney constituting part 1 of the Designed Agreement (part 4.1 of SWZ), in particular the Contractor obliges the Contractor to notify the designated Distribution System Operator to implement the sales contract concluded with the Contractor electricity, the submission of statements of will and the determination on behalf of the Contracting Authority of all necessary information in the field of termination of the existing contract for the sale of electricity and the provision of distribution services (comprehensive agreement), representation of the Contracting Authority before the competent Operator of the Distribution System in matters related to the conclusion of a distribution service contract.

The Ordering Party informs that the process of changing the seller takes place once again. Detailed information on the terms of validity of current contracts for the sale of electricity is included in Appendix No. 1 to SWZ. In Appendix No. 1 to the SWZ, the current electricity seller is indicated. Contracts for the distribution of electricity are concluded for an indefinite period. All customers are entitled to benefit from the maximum price of electricity within the meaning of Article 2(1) of the Act of 27 October 2022 on emergency measures aimed at limiting electricity prices and supporting certain customers in 2023. The Customers will attach to the contracts concluded as a result of this proceeding the STATEMENT OF THE AUTHORIZED RECIPIENT referred to in Article 2(2)(b) to (e) of the Act of 27 October 2022 on emergency measures aimed at limiting electricity prices and supporting certain customers in 2023 (Journal of Laws, item 2243). The Ordering Party reserves the right to change the purpose and affiliation of electricity consumption points to a specific customer and thus the possibility of changing the % share of consumption, which will be covered by tariff protection.
