1. The subject of the contract is the provision of services in the field of transport and management (collection and treatment) of municipal waste: a) non-segregated (mixed) municipal waste – waste code 20 03 01, in the amount of 2400 Mg / year, transferred for recovery and disposal in accordance with applicable regulations – R12 recovery process, b) biodegradable waste, i.e. kitchen bio-waste – waste code 20 01 08 in the amount of 200Mg / year, sent for recovery in the recovery process R3, c) biodegradable waste, i.e. green waste - waste code 20 02 01 200Mg/year - transferred for recovery in the recovery process R3, d) separately collected waste - waste code 15 01 01, 20 01 01, 15 01 02, 20 01 39, in the amount of 700 Mg / year, transferred for recovery and recycling, e) bulky waste – waste code 20 03 07, in the amount of 350Mg/year, transferred for recovery and disposal – R12 recovery process, generated by residents of the Sułkowice commune, delivered by the entity collecting municipal waste, for a period of 12 months, i.e. from 1.01.2023 to 31.12.2023. 2. The transport of waste will take place from the transshipment point, located in Sułkowice at 133 Tysiąclecia Street, to the place of their management, in accordance with the requirements set out in the provisions of the Act of 14 December 2012 on waste (i.e. 2022 Journal of Laws, item 699). 3. This information is provided in order to illustrate the existing situation and has been obtained from reports provided by entities providing municipal waste management services in the Sułkowice Municipality. The amount of waste generated does not depend on the Ordering Party, the calculated amount is an estimate and may change according to the actual needs of the Ordering Party. The Ordering Party reserves the right to reduce or increase the amount of waste transferred to management, depending on the actual needs, without the Contractor's right to claim compensation in this respect. 4. Designation of the subject of the contract according to the codes of the Common Procurement Dictionary (CPV) • 90 50 00 00-2 - services related to waste, • 90 51 10 00-2 - waste disposal services, • 90 51 20 00-9 - waste transport services, • 90 51 31 00-7 - services of export of waste from households, • 90 53 30 00-2 - waste management services The Contracting Authority will be responsible for loading waste onto means of transport provided by the Contractor. Supplementary contracts referred to in Article 214(1)(7): The contracting authority provides for the possibility of awarding, within 3 years from the date of awarding the basic contract to the existing service provider, a contract consisting in the repetition of similar services with a total value of up to 50% of the value of the basic contract. These orders include: • Management of collected municipal waste along with transport from owners of inhabited properties, summer houses and other properties used for recreational purposes, from the area of the Sułkowice commune. • The contract will be awarded after the procedure provided for direct contracting, will be preceded by an appropriate invitation to negotiations and negotiations. 8. Local Vision: The Ordering Party does not require an on-site inspection.

1. Provision of containers for the collection of municipal waste: a. two containers for non-segregated (mixed) waste of capacity. 40m3, b. two containers for biodegradable waste with a capacity of 20m3, and c. two containers for segregated waste with a capacity of 40m3 Containers should be substituted by 31.12.2022, unless the conclusion of the contract takes place after this date (in this case 2 working days from the date of conclusion of the contract). 2. Ensure that it is possible to collect the above-mentioned waste continuously without delay. 3. Handling substituted containers (exchange) on working days of the week, i.e. from Monday to Friday from 7:00 to 15:00 4. Waste collection, after prior notification (by phone or e-mail) by the Ordering Party, but the time from notification to the collection of collected waste may not be longer than 48 hours. 5. Transport of waste, which takes place from the transshipment point located in Sułkowice at Tysiąclecia 133: a. Unsegregated (mixed) municipal waste - to municipal installations placed by the Marshals of the Voivodships in the Public Information Bulletin and to municipal installations indicated in the Provincial Municipal Waste Management Plans (RIPOK installations – indicated in the Provincial Waste Management Plan of the Małopolska Region); b. selectively municipal waste to the installation of recycling, recovery and disposal of waste, in accordance with the waste hierarchy referred to in Articles 17 and 20 of the Act of 14 December 2012 on waste (i.e. Journal of Laws of 2022, item 699). 6. Weighing municipal waste on an electronic scale located in Sułkowice at 133 Tysiąclecia Street. The container used for the transport of waste covered by the order should be weighed twice each time, the first weighing without waste, the second weighing with waste. 7. Waste management is to be confirmed by a waste transfer card, which will be confirmed by the Contractor in accordance with applicable regulations. 8. Providing the Ordering Party, for each month of the service provided, with copies of weight receipts confirming the weight of municipal waste accepted from the Sułkowice Commune and the date of their acceptance into the installation. 9. Ensuring, during the term of the Agreement, the achievement of efficiency indicators in the management of non-segregated (mixed) municipal waste in the scope of: recovery from mixed segregated waste and reduction of the mass of biodegradable municipal waste transferred to landfill, in accordance with the provisions of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e. Journal of Laws of 2022, item 1297, as amended), the provisions of the Waste Management Plan of the Malopolska Region for the years 2016-202244.4. The Ordering Party requires employment on the basis of an employment relationship by the Contractor or Subcontractor of persons performing the following activities during the performance of the contract: - the driver of the car collecting waste 1) During the performance of the contract, the Ordering Party is entitled to perform control activities towards the Contractor regarding the Contractor's or Subcontractor's compliance with the employment requirement on the basis of the employment relationship of persons performing the activities indicated in point III.4.
