Comprehensive electricity supply and provision of electricity distribution services for street lighting, buildings

And facilities managed by the Świlcza commune and organizational units of the Świlcza commune

1. The subject of the contract is a comprehensive supply of electricity and the provision of electricity distribution services for the needs of street lighting, buildings and facilities managed by the Municipality of Świlcza and organizational units of the Municipality of Świlcza.

2. Required delivery parameters:

Electricity should meet technical standards in accordance with the provisions of the Energy Law and executive regulations to this Act

And Polish Standards.

3. Order quantity:

The estimated amount of energy supplied over the full contract period (12 months) is 1,625,714 kWh, including:

- energy settled around the clock in the C11 group: 1.240.000 kWh,

- energy settled around the clock in the C21 group: 305,714 kWh,

- energy in the peak zone for the C22a group: 24,000 kWh,

- off-peak energy for the C22a group: 56,000 kWh.

The amounts given reflect the amount of consumption calculated based on the same past period and do not constitute the Purchaser's obligation to purchase exactly these quantities. This means that the Employer will collect the amount of energy resulting from the actual indications of the measuring systems during the contract period, the settlement will be based on the amounts shown in full, and the issue of any discrepancies with the amounts shown in the tender cannot be the basis for any claims of the Contractor, regardless of whether these quantities will be higher or lower than expected.

The Employer also allows the possibility of changing the number of energy consumption points indicated in Annex 6 to the ToR. The change in the number of electricity consumption points may result from the liquidation or transfer of the consumption point to another owner. The change may also result from the increase in the number of energy consumption points referred to in Annex 6 to the ToR. Settlement of any additional collection points will be carried out according to the same settlement rate that was offered in the tender.

Continued changes to the contract of Section III.2.2);

1) a change in the content of the contract with respect to the scope of the subject of the contract: i.e. a change in the contracted capacity or connection capacity of existing points resulting from the analysis of power consumed in 2018 - after obtaining the DSO's consent for such a change, changes in the forecasted amount of electricity consumption, resulting, among others . from a change in the contracted capacity and a reduction or increase in the number of places for the supply of electricity (connections, consumption points), supply and transmission of energy to other facilities not indicated in the Annex to the contract or in the event of an increase in supply along with the transmission of energy to the facility in connection with the extension, reconstruction facilities, etc. Increasing the amount of PPE or changing the tariff group of a given point is only possible within those tariff groups that have been defined and valued in the offer;

2) changes in the content of the agreement regarding the price for energy distribution in the event of a change in the distribution system tariff of the Distribution System Operator approved by the President of the Energy Regulatory Office and unit prices for the sale of energy given in the price form - only in the case of a statutory change in excise tax and VA T pending tax implementation of this contract;

3) changes in applicable regulations, if it is necessary to adjust the amount of remuneration to the current legal status, including in the event of a change in the rate of excise duty or other changes to generally applicable legal provisions, in particular amendments to the Energy Law or executive acts to this Act introducing or removing additional obligations related to the purchase of property rights or energy efficiency certificates. The change in the amount of remuneration in this case applies to both the increase and reduction of remuneration due to the reasons described above. The change occurs automatically from the day of its entry into force without the need to draw up an annex to the contract;
