The subject of the contract is the construction of a dolphin type swimming pool with the necessary technical infrastructure.
The subject of the contract includes in particular:
1) earthworks,
2) execution of external and internal walls,
3) execution of elements of reinforced concrete structures,
4) execution of the roof structure with roofing,
5) execution of the ceiling, stairs and floors,
6) execution of swimming pool basins with the necessary pool technology,
7) installation of window and door joinery,
8) execution of façade works,
9) execution of internal plasters with painting works,
10) execution of supply and exhaust ventilation installation,
11) execution of internal and external installations: water and sewage, central heating and electricity,
12) execution of a collector for draining pool water,
13) planting and greenery,
14) construction of internal roads, sidewalks and parking spaces,
15) construction of a temporary access road to the construction site.
The detailed scope of the subject of the contract is specified in Annexes 3-5 to the SWZ.
The detailed scope of the subject of the contract is specified in particular by the design documentation, technical specification for the execution and acceptance of works, and documentation on replacement plantings constituting Annexes 3-5 to the SWZ.
The Contracting Authority informs that in accordance with Article 101 paragraph 4 of the PPL, if the description of the subject of the contract includes a reference to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 paragraph 1 point 2 and paragraph 3 of the PPL, the Contracting Authority allows solutions equivalent to those described.
The contracting authority sets the minimum warranty period for the subject of the contract at 36 months, and the maximum at 60 months, in accordance with the adopted criterion for the evaluation of offers "Warranty period".
It is recommended that the Contractor makes a local inspection of the area related to the implementation of the subject of the contract. The on-site inspection may be made only on working days, i.e. from Monday to Friday, but no later than 3 days before the deadline for submitting offers. The Contractor is obliged to notify the Contracting Authority in writing of the intention to carry out the inspection. Persons on the side of the Ordering Party, who will show the area, are not authorized to conduct any arrangements.
A detailed description of the conditions for the execution of the subject of the contract is contained in the Model Agreement as Annex 2 to the SWZ.
Pursuant to Article 95(1) of the PPL, the Contracting Authority requires that activities in the field of masonry, reinforcement, concrete works as well as electrical and sanitary installations be performed by persons employed by the Contractor or Subcontractor on the basis of an employment contract.
The Contracting Authority requires the Contractors submitting the offer to lodge a bid bond before the deadline for submitting tenders in the amount of PLN 850,000 (eight hundred fifty thousand PLN).
The Contractor shall be obliged to bring a defect on the deadline for binding the offer.
If the bid bond is not paid or the bid bond is not improperly lodged or the bid bond is not maintained continuously until the expiry of the deadline for binding the offer or submission of an application for the return of the bid bond in the case referred to in Article 98 paragraph 2 point 3 of the PPL, the Contractor's offer will be rejected from the procurement procedure.
The security may be lodged in one or more of the following forms:
1) money;
2) bank guarantees;
3) insurance guarantees;
4) sureties granted by entities referred to in Article 6b paragraph 5 point 2 of the Act of 9.11.2000. on the establishment of the Polish Agency for Enterprise Development.
In the case of a bid bond in the form of a guarantee or surety referred to in point 4 points 2-4 above, its content should result in an unconditional, irrevocable and at the first written request submitted by the Ordering Party (within the period of binding the offer) obligation of the Guarantor to pay the Ordering Party the full amount of the bid bond in the circumstances specified in Article 98 paragraph 6 of the PPL.
The bid bond paid in the form of guarantees or sureties referred to in point 4 points 2-4 should be submitted to the Contracting Authority in the form of the original guarantee or surety, in electronic form and should be submitted to the Contracting Authority before the deadline for submitting tenders.
The bid bond paid in money shall be paid by the Contractor by bank transfer to the bank account of the Ordering Party-Bank PKO BP SA number 31 1020 5040 0000 6902 0085 9652:
1) the recognition by the Ordering Party that the deposit in money was paid within the required time shall be determined by the date and time of receipt of funds on the account of the Ordering Party;
2) when placing a defect, the Contractor should specify the name of the object of the order and the case number.
The contracting authority shall return or retain the bid bond in accordance with the principles set out in Article 98 of the PPL.
