The subject of the contract is the performance by the Contractor of the sorting line service in the field of maintaining cleanliness and separating raw material fractions from waste and post-sorting ballast on the premises of the Plant / Installation "EKO-REGION" sp. z o.o. in Julków, Skierniewice commune.

1. The subject of the contract is the performance by the Contractor of the sorting line service in the field of maintaining cleanliness and separating raw material fractions from waste and post-sorting ballast on the premises of the Plant/Installation "EKO-REGION" sp. z o.o. in Julków, Skierniewice commune.

2.The scope of the work must be carried out on the basis of the contract and its annexes, i.e.:

1) Place and scope of performance of the service and the scope of duties of the Contractor – Annex 1 to the contract.

2) Settlement template – Annex 2 to the contract.

3) Contractor's statement – Annex 3 to the contract.

4) Agreement on cooperation between employers (Article 208 of the Labour Code) – Annex 4 to the agreement.

3.Us the service referred to in point 1 will be performed by the Contractor independently, i.e. without the participation of subcontractors in the key part of the contract, i.e. in the scope of separating raw material fractions from waste and sorting ballast.

4.The contracting authority provides that the subject of the contract will be provided in two shifts on working days from Monday to Friday. The daily working time will be 16 hours. The subject of the contract will be carried out between 600 and 2200. The estimated number of man-hours for the entire term of the contract, i.e. 12 months, is 90 072 rbh. Detailed working time is specified in Annex 1 to the SWZ and the contract.

5.The number of hours specified in point 4 of this paragraph and in Appendix No. 1 to the SWZ for each of the mentioned activities may change. The Ordering Party has the right to determine the daily number of hours for each of the activities listed in Annex 1 to the SWZ on each shift, taking into account the possibility of shortening the number of working hours on a given shift. Therefore, the Ordering Party, in the course of the contract, reserves the right to limit the total number of hours by a maximum of 60%. Reducing the number of hours in this respect shall not give rise to any claims against the Contracting Authority on the part of the Contractor, in particular for payment of remuneration for the unfulfilled part of the contract and for payment of compensation in connection with the reduction of the number of hours specified in point 4 and in Annex 1 to the SWZ.

In this situation, no addendum is required. The Contracting Authority guarantees the Contractor a minimum of 40% of the number of hours to be worked during the term of the contract.

6. The Ordering Party reserves the right to commission the Contractor to work on Saturdays. If it is necessary to work on Saturdays, the Contracting Authority shall inform the Contractor 7 days in advance in electronic form, in which it will specify the number of hours for each of the activities listed in Annex 1 to the SWZ (the maximum number of working hours on Saturday is two shifts of eight hours each). The work order on Saturday does not require the conclusion of an annex between the Parties, and the settlement of the service will take place in such a case in accordance with § 6 of the contract. If the Contractor does not provide full staff for work on Saturday, the Contracting Authority shall be entitled to impose a contractual penalty on the terms referred to in § 8 clause 1 point 1) of the contract.

7. The Ordering Party reserves the right to periodically suspend the performance of the service due to the stop of the sorting line resulting from maintenance and repair works, etc., about which it will notify the contractor 24 hours in advance. In the event of a failure of the sorting line, the Ordering Party shall immediately notify about the situation and specify the approximate time of suspension of the service. The inability to perform the service on the part of the Contractor shall not give rise to any claims against the Contracting Authority on the part of the Contractor, in particular for payment of remuneration for the unfulfilled part of the contract and for payment of compensation due to the inability to perform the service.
