Campaign promoting the "Career Direction" project

The public contract is awarded in the form of an open tender in accordance with art. 39 et seq. of the Public Procurement Law (i.e. Journal of Laws of 2019, item 1843), hereinafter referred to as the Act, with an estimated value exceeding the amount specified in the provisions issued on the basis of art. 11 paragraph 8 of the PPL Act.

The subject of the contract is the implementation of a campaign encouraging employed residents of Lesser Poland to use training in the "Career Direction" project.

The order will be carried out from the day of signing the contract until December 7, 2020.

A detailed description of the Object of the Order (SOPZ) is set out in Annex 1 to the ToR (which is also Annex 1 to the contract).

If the description of the subject of the order includes names of trademarks, patents or origin, this should be treated only as an aid in the description of the subject of the order.

In any case, equivalent products in terms of design, parameters, purpose, etc. are allowed.

The Employer requires employment on the basis of an employment contract by the Contractor or a subcontractor of persons performing the following activities during the performance of the contract: preparation for printing and printing: posters, advertising on the backs of seats in trams and full truck advertisements (point XXI of the ToR).

The terms of the contract are included in the Contract template constituting Annex 2 to the ToR.

The Purchaser does not allow the submission of a variant offer.

The contracting authority does not provide for the possibility of awarding contracts referred to in art. 67 section 1 points 6 and 7 or in art. 134 section 6 point 3 of the Act.

The Purchaser does not provide:

1) conclusion of a framework agreement;

2) establishing a dynamic purchasing system;

3) selection of the best bid using electronic auction.

The Purchaser does not allow the submission of partial offers. The offer that does not cover the entire subject of the contract will be rejected as inconsistent with the content of the ToR.

The contracting authority in the procedure provides for the use of the procedure referred to in art. 24aa section 1 of the Act (the so-called "reverse procedure").

All information constituting a trade secret within the meaning of the Act of 16.4.1993 on combating unfair competition (i.e. Journal of Laws 2019 item 1010), which the Contractor reserves as a trade secret, should be submitted in a separate file together with the " Annex constituting the trade secret ', followed by the files constituting the non-confidential part compressed into one archive file (ZIP). Additional information on business secrets can be found in Chapter X point 2 of the ToR.

1. Before the deadline for submission of bids, the Contractor is obliged to submit a bid bond, for a period equal to the period of the bid in the amount of PLN 20,000.00, in words: twenty thousand zlotys.

2. The bid submission deadline expires with the submission deadline.

3. The bid bond may be lodged in one or several forms mentioned in art. 45 item 6 of the Act.

4. The bid bond in cash should be transferred to a bank account at the bank PKO Bank Polski No. 40 1020 2892 0000 5302 0667 7456 so that the bid bond was on the Purchaser's bank account before the deadline for submitting bids; the bid bond should be paid with the title 'bid bond - tender - Career Direction campaign.

5. The bid bond in the remaining forms should be brought to the Employer in the same way as an offer (described in point X.2 of the ToR) or to the e-mail address before the deadline for submitting offers. The Awarding Entity requires the submission of an original electronic document. As the original electronic document, the Purchaser understands an electronic document issued by the guarantor / guarantor or a document signed by the guarantor / guarantor by a qualified electronic signature. The above condition is not met by an electronic copy of the document signed by the Contractor by a qualified electronic signature.

6. The bid bond paid in forms other than in money should guarantee the Ordering Party the payment of the bid bond in the event of circumstances specified in art. 46 section 4a and paragraph 5 point 1) and 3) of the Act.

7. It is unacceptable to introduce any conditions restricting the payment of the bid bond to the Ordering Party.
