It is not an open procedure, but a so-called open house model! The form for the open procedure is only used because there is no form for the open house model. Contracts concluded in the open house model are not subject to public procurement law due to the lack of a selection decision. Submission to procurement regulations is not associated with the use of this form.

AOK Bayern intends to conclude non-exclusive discount agreements with all interested pharmaceutical companies concerning the active substance formoterol, glycopyrronium bromide and beclomethasone, ATC R03AL09, in accordance with section 130a paragraph 8 of the German Civil Code V.
