The subject of the contract is the provision of Service A to the Ordering Party.

1. The subject of the contract is the provision of Service A to the Contracting Authority, which consists of transporting Consignments, including Consignments of which will constitute postal consignments and the contents of which will constitute dangerous goods within the meaning of Article 2 (4) of the Act on 19 August 2011. on the transport of hazardous materials, whereby the Contractor is obliged to accept Consignments for carriage at the place and time specified in the Schedule of the implementation of Service A, annex 1 to the draft contract, and issue Consignments accepted for carriage at the place specified in this annex.

2. Under the provision of Service A, the Contractor undertakes:

(a) that the vehicle using which the Consignments are transported will arrive at the place of issue of the Shipments within the time limit set out in the Schedule for the implementation of Service A, as set out in Annex 1 to the draft agreement,

(b) where the place of acceptance of consignments for carriage is not the organizational unit of the Contracting Authority - the loading of the Consignments onto the vehicle and their placement in the vehicle at the place of acceptance of the consignments for carriage,

(c) where the place of release of the Shipments is not the organizational unit of the Ordering Party - the discharge of the Shipments from the vehicle at the place of release of the Shipments.

The maximum amounts of services that can be commissioned to the Contractor by the Employer as part of the contract:

- the maximum number of kilometers with the right of option (100%) - 269 698,

- the number of km covered by the so-called basic contract (80%) - 215 758,

- the number of kilometers covered by the right of option (20%) - 53 940.

3. Estimated number of vehicles necessary for the service: 2 vehicles of category IV.

4. Estimated number of persons necessary to provide the service: 2 persons holding a category C driving licence.

5. In the event that during the term of the contract the amount of the Contractor's remuneration does not reach the maximum remuneration, the Parties may agree to extend the duration of the contract by a maximum of 4 months, but not longer than until the amount of remuneration for services performed by the Contractor reaches the maximum remuneration.

6. The Contracting Authority provides for the possibility of granting services to the existing Contractor, in the mode of a free hand contract pursuant to Article 388 (2) (c) of the Pzp Act, a contract consisting in repetition of similar services, in accordance with the subject of the basic contract.

Conditions under which the above contracts will be awarded from the free hand:

(1) The scope of the above contracts shall consist in the repetition of the services from the basic contract and shall cover the following number of km:

- the maximum number of kilometers with the right of option (100%) - 224 750,

- the number of km covered by the so-called basic contract (80%) - 179 800,

- the number of kilometers covered by the right of option (20%) - 44 950.

2) The draft contract will be forwarded to the Contractor together with an invitation to negotiate;

3. Contractual penalties will be provided for in the same cases as in the contract concluded in the basic procurement procedure;

4) the obligations of the Contractor and the Contracting Authority shall be governed on a basis analogous to the contract concluded in the procedure for the basic contract;

5) Order period: up to 10 months.

(c) where the place of release of the Shipments is not the organizational unit of the Ordering Party - the discharge of the Shipments from the vehicle at the place of release of the Shipments.

The maximum amounts of services that can be commissioned to the Contractor by the Employer as part of the contract:

- the maximum number of kilometers with the right of option (100%) - 214 038,

- the number of km covered by the so-called basic contract (80%) - 171 230,

- the number of kilometers covered by the right of option (20%) - 42 808.

3. Estimated number of vehicles necessary for the service: 2 vehicles of category IV B.

4. Estimated number of people necessary to provide the service: 2 people with a driving license category C + E.

5. In the event that during the term of the contract the amount of the Contractor's remuneration does not reach the maximum remuneration, the Parties may agree to extend the duration of the contract by a maximum of 4 months, but not longer than until the amount of remuneration for services performed by the Contractor reaches the maximum remuneration.

6. The Contracting Authority provides for the possibility of granting services to the existing Contractor, in the mode of a free hand contract pursuant to Article 388 (2) (c) of the Pzp Act, a contract consisting in repetition of similar services, in accordance with the subject of the basic contract.

Conditions under which the above contracts will be awarded from the free hand:

(1) The scope of the above contracts shall consist in the repetition of the services from the basic contract and shall cover the following number of km:

- the maximum number of kilometers with the right of option (100%) - 178 400,

- the number of km covered by the so-called basic contract (80%) - 142 720,

- the number of kilometers covered by the right of option (20%) - 35 680.

2) The draft contract will be forwarded to the Contractor together with an invitation to negotiate;

3. Contractual penalties will be provided for in the same cases as in the contract concluded in the basic procurement procedure;

4) the obligations of the Contractor and the Contracting Authority shall be governed on a basis analogous to the contract concluded in the procedure for the basic contract;

5) Order period: up to 10 months.
