Order description. The subject of the contract is a comprehensive supply of electricity, including the sale of electricity and the provision of electricity distribution services for the needs of buildings and facilities of the municipality of Nakło nad Notecią and its organizational units as well as the Museum of the Krajeńska Land, Nakielskie Ośrodek Kultury as well as the Poviat and Municipal Public Library.

Order description.

1) The subject of the contract is a comprehensive supply of electricity including the sale of electricity and the provision of electricity distribution services for the needs of buildings and facilities of the municipality of Nakło nad Notecią and its organizational units as well as the Museum of the Krajeńska Land, Nakielskie Centrum Kultury as well as the Poviat and Municipal Public Library.

2) The Contractor will provide electricity that meets technical standards in accordance with the provisions of the Energy Law and executive regulations to this Act and Polish standards.

3) The total estimated demand for the comprehensive supply of electricity during the contract period is: 2 574.46 MWh.

The amount of electricity demand indicated above is an estimated value estimated for each of the electricity consumption points with due diligence based on the current electricity consumption. The above does not reflect the real use of electricity during the contract period and under no circumstances may it give rise to any claims on the part of the Contractor. The Contractor's remuneration will be calculated according to the unit prices and fees specified in the offer and the actual electricity consumption at individual consumption points.

4) The Contractor should take into account the fluctuation of electricity consumption at the level of ± 15% in total for the entire volume. In this respect, the Contractor may not make any additional extensions. The indicated tolerance regarding the increase in the volume being the subject of the contract should be understood as the right of options within the meaning of the provisions of art. 34 section 5 of the Public Procurement Law. The remuneration in this respect will be calculated according to the rates specified in the offer.

5) A detailed description of the subject of the contract is set out in Annex 6 to the ToR. The amounts of electricity demand set out in the annex are estimates, which does not reflect the actual or declared use of electricity during the contract period.

6) Settlements for electricity will take place on the basis of real current indications of measuring and billing systems according to prices and rates of charges included in the Contractor's offer.

7) The supply of electricity and the provision of distribution services will take place under the conditions set out in the Act of 10.4.1997 - Energy Law and its implementing provisions, in particular the Regulation of the Minister of Energy of 6.3.2019 on detailed rules shaping and calculating tariffs and settlements in electricity trading, the tariff for electricity distribution services of the relevant Distribution System Operator (DSO Tariff), the Instructions for the Operation and Maintenance of the Distribution Network (IRiESD) of the relevant Distribution System Operator, i.e. Enea Operator Sp. z o. o. and generally applicable laws.

8) The Ordering Party is connected to the network of the Enea Operator Sp. z o. o. with headquarters in Poznań ul. Strzeszyńska 58, 60-479 Poznań, POLAND.

9) The Contractor will be required to act as the entity responsible for trade balancing. All costs related to balancing will be included in the price of electricity.

10) Purchased electricity will be used in real time, there are no costs associated with the product life cycle. There are also no additional costs associated with the consumption of electricity.

11) When purchasing electricity, none of the criteria listed in art. 91 section 2 points 1) to 6) of the Act of 29.1.2004 Public Procurement Law (i.e. Journal of Laws of 2018, item 1986, as amended).
