The subject of the contract is the service of granting and servicing a long-term bank loan taken out in the amount of PLN 5,036,000.00 (in words: five million thirty-six thousand 00/100), of which to finance the deficit in the amount of PLN 2,761,940.00 and to repay previously incurred liabilities under loans and advances in the amount of PLN 2,274,060.00.

1.1. The subject of the contract is the service of granting and servicing a long-term bank loan taken out in the amount of PLN 5,036,000.00 (in words: five million thirty-six thousand 00/100), of which to finance the deficit in the amount of PLN 2,761,940.00 and to repay previously incurred liabilities under loans and advances in the amount of PLN 2,274,060.00.

1.2. The funds obtained from the loan will be m.in intended to finance the deficit resulting from, among others, the implemented investments, including financing own contributions to projects implemented by the Municipality of Sękowa on the basis of co-financing agreements with the participation of the European Union budget or the funds of the Interreg V-A Poland-Slovakia Cross-Border Cooperation Programme 2014-2020 in the amount of PLN 1,811,000.00.

1.3. The loan will be activated in the form of tranches to the basic account of the commune budget, of which the probable dates of payment of tranches: 1 December 2022 in the amount of PLN 2 500 000.00 and 23 December 2022 in the amount of PLN 2 536 000.00. The final amount and dates of transfer of loan tranches will be each time agreed with the Contractor and submitted in the form of instructions within no more than 1 business day before the loan tranche is launched. Applications to the Contractor will be sent by the Ordering Party electronically.

1.4. The Ordering Party reserves the right not to charge the full amount of the loan. In this case, the Contractor shall not charge the Ordering Party for the costs of not collecting the loan amount.

1.5. Repayments of capital installments and interest are included in the main table of the Multiannual Financial Forecast of the Municipality of Sękowa, constituting Annex No. 1 to Resolution No. XXXIX/401/2022 of the Sękowa Commune Council of September 9, 2022 on the amendment of the Multiannual Financial Forecast of the Sękowa Municipality.

1.6. A grace period for repayment of the loan shall be fixed until 30 March 2023. No grace period in interest payment is established.

1.7. Repayment of capital instalments shall commence on 31 March 2023 and shall last until 31 October 2036 and shall not exceed the following amounts in individual years:

- in 2023 – PLN 100,000.00

- in 2024 – PLN 200,000.00

- in 2025 – PLN 287,000.00

- in 2026 – PLN 215,000.00

- in 2027 – PLN 300,000.00

- in 2028 – PLN 470,000.00

- in 2029 – PLN 470,000.00

- in 2030 – PLN 500,000.00

- in 2031 – PLN 420,000.00

- in 2032 - PLN 420,000.00

- in 2033 - pln500,000.00

- in 2034 - PLN 500,000.00

- in 2035 - PLN 454,000.00

- in 2036 - PLN 200,000.00

Repayment of capital installments will take place by the last day of a given month according to the schedule contained in the table indicated in the SWZ.
