The subject of the contract is the collection and processing of 9 000 Mg of waste with the code 19 12 12, i.e. – other waste (including mixed substances and objects) from mechanical waste treatment other than those mentioned in 19 12 11, generated in the technological process of mechanical waste treatment at the Municipal Waste Disposal Plant in Płoszów. A detailed description of the subject of the contract is set out in Annex 7 to the SWZ.
I. The scope of the contract includes: Collection, transport and processing, including supervision of such activities, of waste generated after the waste treatment process, from which an over-sieve fraction with a granulation above 60 mm, marked with code 19 12 12, is separated. Estimated amount of waste to be managed – 9 000 Mg. The Ordering Party reserves that the given quantity is indicative, illustrates the possible size of the scope of the subject of the contract and may change depending on the needs. II. Description of receipt of the subject of the contract: 1. The Contractor will collect waste by means of transport on its own and at its own expense. 2. Loading of waste by the Ordering Party shall take place on working days from Monday to Friday from 6:00 a.m. to 5:00 p.m. in accordance with the schedule and on Saturdays, each time at the individual request of the Ordering Party, from 6:00 a.m. to 12:00 p.m. 3. The collected waste will be weighed each time on a legalized truck scale located in ZUOK. Weighing will be confirmed each time in the BDO system. 4. Waste registration documents, i.e. the Waste Transfer Card, shall be prepared by the Ordering Party each time via an individual account in the Database on products and packaging and on waste management (in accordance with the Waste Act of 14 December 2012, as amended). Documents in the form of proof of weighing and Waste Transfer Card generated by the Ordering Party will constitute the sole basis for determining the weight of collected waste between the Contracting Authority and the Contractor. The Waste Transfer Card generated by the Contracting entity and accepted by the Contractor/Subcontractor by granting it the status of "Completed takeover" in the BDO system will confirm the management of the seized waste by the Contractor/Subcontractor in accordance with the presented administrative decision and legal regulations. 5. On the basis of weighing proofs and Waste Transfer Cards generated by the Ordering Party, settlements with the Contractor will take place. The unit price for 1 Mg calculated by the Contractor will be the basis for determining the amount due for the amount of waste actually collected in a given month. The unit price will include all costs, including m.in costs of transport and waste management. 6. The Contractor shall be solely responsible for any damage, as well as for loss, loss and damage to waste resulting from the transport of waste from the moment of their release by the Municipal Waste Disposal Plant in Płoszów, 97-500, 40 Jeżynowa Street, and during storage, unloading of waste until it is processed and the management processes are completed. The Contractor shall be liable in particular for acts of omission of its personnel and entities used to perform the subject of the contract, e.g. Carriers. Upon release of waste to the Contractor (to the Carrier indicated by him), all benefits and burdens associated with them and the risk of their accidental loss or damage shall pass to the Contractor, in particular he shall take responsibility for the waste dispensed, for its proper handling and for the consequences resulting therefrom. 7. Waste collection will take place on the basis of a weekly schedule of shipments planned for the following week, provided by the Ordering Party by e-mail, up to and including Thursday of each week. The schedule will include the date and number of loads for individual days. Estimated number of receptions 2 per day - 10 per week. The Contractor, on the other hand, will specify 1 day before the acceptance of the time of substitution of the car for loading the subject of the contract, in the event of a change in the time or date of loading, the Ordering Party will individually inform the Contractor about the possibility of loading. 8. Control of the adopted schedule will be carried out on a continuous basis – on a daily basis by verifying the actually completed acceptances, and the lack of its implementation will constitute the basis for calculating contractual penalties.
