The subject of the proceedings is "Supply of electricity to the Purchasing Group established by the City of Leszno in 2020-2021".

The Contractor is obliged to execute the order for Part I, Part II, Part III, Part IV, Part V Part VI on the terms and conditions specified in the specimens of the agreements constituting the attachments to the ToR. Electricity will be supplied in accordance with applicable law, in particular on the conditions set out in the Act of 10.4.1997 - Energy Law (Journal of Laws of 2019, item 755, as amended), implementing regulations for this Act, in particular the Regulation of the Minister of Economy of 4.5.2007 on detailed conditions for the operation of the power system (Journal of Laws of 2007 No. 93, item 623, as amended), Regulation of the Minister of Energy of 6.3.2019 on detailed principles of shaping and calculating tariffs and settlements in the trade in electricity (Journal of Laws of 2019, item 503).

Part I - the order includes the supply of electricity in the planned quantity of 6 837 992 kWh from 1 October 2020 to 31/12/2020 (12 months) to the electricity consumption points in accordance with Annex 1A to the ToR.

A detailed description of the subject of the order along with the list of electricity consumption points for Part I of the subject of the contract is included in Appendix No. 1A to the ToR. Declared in the above Annexes, the consumption of electricity is an approximate amount and is used only to calculate the price of the Offer.

The electricity supply will be carried out on the basis of a contract for the sale of electricity, referred to in Article 5 para. 2 points 1 of the Act of 10.4.1997 - Energy Law (Journal of Laws of 2019, item 755, as amended).

This order does not cover the provision of electricity distribution services.

The authorized orderer informs that within Part I, II, III, IV, V and VI of the subject of the contract, the Contractor is responsible for commercial balancing and must be the Responsible Trade Balancer (so-called POB).

The contracting party, within the framework of the contract in question, provides for the option to exercise the right of option in the circumstances and in the periods referred to below.

Part II - the order includes the supply of electricity in the planned amount of 7.641.983 kWh

In the period from 01/01/20120 to 31/12/2020 (12 months) to the electricity consumption points according to Annex No. 1B to the ToR.

Declared in the above Annexes, the consumption of electricity is an approximate amount and is used only to calculate the price of the Offer.

The electricity supply will be carried out on the basis of a contract for the sale of electricity, referred to in Article 5 para. 2 points 1 of the Act of 10 April 1997 - Energy Law (Journal of Laws of 2019, item 755, as amended).

This order does not cover the provision of electricity distribution services.

The authorized orderer informs that within Part I, II, III, IV, V and VI of the subject of the contract, the Contractor is responsible for commercial balancing and must be the Responsible Trade Balancer (so-called POB).

The contracting party, within the framework of the contract in question, provides for the option to exercise the right of option in the circumstances and in the periods referred to below.

Part III - the order includes the supply of electricity in the planned quantity of 1,356,345 kWh, while the Contractor performs the function of the entity responsible for commercial balancing to account for unbalanced electricity collected and supplied (produced in a biogas power plant located on the premises of the Employer) from the system and to the system as well as the sale of electricity generated at the Ordering Party's power plant and introduced into the power grid of the DSO designated for resale from 01.01.2020 to 31.12.2020 (12 months) to electricity consumption points in accordance with Annex No. 1C to SIWZ. The Ordering Party is the payer of excise tax for electricity consumption points indicated in Part III.
