Description:
Successive supply of liquid fuel (diesel fuel).

1. The subject of the contract is the successive delivery of diesel fuel to the tanks located at the service station of Przedsiębiorstwo Usług Komunalnych located in Komorniki at 1 Zakładowa Street in the amount indicated by the Ordering Party.

2. Maximum amount of fuel covered by the contract during the delivery period: 700 m3.

3. The order size was estimated on the basis of the quantity of diesel fuel delivered during the 12 months preceding the determination of the order size. The actual scope of the order may change and will be determined on the basis of the actual quantity of oil delivered, however, during the term of the contract it will not exceed the quantity indicated in paragraph 2 and will not be less than 80% of the estimated order quantity.

4. The Contractor shall be entitled to remuneration only for the amount of fuel actually supplied, taking into account paragraph 3.

1. The subject of the contract is the successive delivery of liquid fuel (diesel fuel) in the amount of 700 m³ delivered according to the real needs of the Ordering Party in one-off successive deliveries of at least 3m³.

2. The Contractor is obliged to deliver the subject of the contract by its own means of transport on working days and Saturdays within 8 hours of receiving the order, and in an emergency on Sundays and holidays within 10 hours of placing the order, at its own expense, to the Ordering Party's warehouse located at the service station of the Municipal Services Company located in Komorniki at 1 Zakładowa Street.

3. The Contractor guarantees delivery to the Ordering Party in the amount of approx. 50m3 per month.

4. The Ordering Party has two above-ground tanks with a capacity of 5m3 each.

5. The subject of the contract should meet the following quality parameters:

5.1. Flash point: above 55 degrees Celsius

5.2. Water content: maximum 200 mg/kg

5.3. Solid impurity content: maximum 24 mg/kg

5.4. Sulphur content: maximum 10 mg/kg

5.5. Temperature of blocking the cold filter during the summer (from 16 April to 30 September) maximum 0 degrees Celsius

5.6. Temperature of blocking the cold filter during the transitional period (1 March to 15 April and from 1 October to 15 November) maximum

-10 degrees Celsius

5.7. Temperature of blocking the cold filter in the winter period (from November 16 to the end of February) maximum -20 degrees Celsius

5.8. Density at 15 degrees Celsius: minimum 820 kg/m3, maximum 845 kg/m3 5.9. Viscosity at 40 degrees Celsius: from 2 to 4.5 mm2/s 5.10. Fractional composition:

- up to a temperature of 250 degrees Celsius, distils a maximum of <65 % (V/V); - up to a temperature of 350 degrees Celsius, distils a minimum of 85 % (V/V); - 95% (V/V) distills to a maximum temperature of 360 degrees Celsius.

5.11. Fatty acid methyl ester content: maximum 7,0 % (V/V)

6. The sales unit will be 1m3 (cubic meter) at a reference temperature of 15 degrees Celsius.

7. For fuels received by tanker, the volume shall be calculated on the basis of the indications of the volumetric flow meter and the density at a temperature of 15 degrees Celsius in accordance with PN-ISO91-1 or equivalent.

8. The quantity and volume of deliveries shall depend on the actual demand for fuels in a given period. Fuel consumption varies each month. Therefore, the Ordering Party cannot determine the average number of deliveries, their exact size.

9. The Contractor should guarantee that the fuels sold will meet the quality requirements set out in the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680, as amended) and the requirements specified in the PN-EN 590:2013-12 standard or equivalent.

10. The settlement of the delivery will take place on the basis of a reading from the legalized distributor of the tanker and the WZ document issued on this basis (External Edition). For each delivery – sales invoice, the Contractor shall attach copies of the WZ document (External Edition) of the delivery confirmed by the signature of an authorized representative of the Ordering Party and the Contractor.

11. Orders will be made by persons authorized to represent the Ordering Party or by persons authorized by him.

12. Orders will be placed by phone and e-mail. The Contractor is obliged to make the delivery up to 8 hours – on working days and Saturdays and in an emergency up to 10 hours on Sundays and holidays.

13. The Contractor guarantees the implementation of orders in terms of quantity, quality and the set deadline referred to in point 12.
