Operation of a dynamic purchasing system (DBS) for peer review services in the context of assessment and validation under the EMAS Regulation - Performance category 3 - NACE code 84.1

The present proceedings concern the operation of a dynamic purchasing system (hereinafter referred to as DBS) by means of a restricted procedure.

The subject matter of the DBS is expert services in the context of assessment and validation according to the EMAS Regulation, which are assigned to performance category 3 - NACE code 84.1.

The DBS takes place in two phases, which are described below:

1. Establishment and administration of a pool of bidders

The DBS shall be established for a period of two years. The procedure is carried out exclusively electronically. The contracting authority shall form a pool of tenderers. Any interested party can activate participation in the procedure at any time of the DBS.

After activation of participation in the present DBS, the application for participation can be submitted to the federal government's e-procurement platform (https://www.evergabe-online.de) by message (function "Contact contracting authority"). The receipt will be confirmed to you immediately, at the latest after five working days by the contracting authority.

Any interested party who meets the selection criteria published in this announcement and does not have to be excluded in accordance with §§ 123 or 124 GWB and Article 5k of Regulation (EU) 833/2014 will be included in the bidding pool. He thus becomes a potential bidder and can submit a tender in the subsequent individual awards after being called.

The pool of bidders is not limited in size. Each suitable candidate will be included in the pool of bidders.

2. Offer phase

The individual contracts awarded within the framework of the DBS are carried out according to the needs of the respective stakeholders. The date or number of individual contracts awarded shall be decided by the contracting authority.

It is expressly pointed out that there is no obligation on the part of the contracting authority to carry out individual contracts.

On the occasion of the individual award of the contract, the contracting authority invites all bidders of the pool of tenderers admitted to the DBS to submit a tender and informs them of the specific conditions of the contract (e.B user, real estate, execution period).

Applicants must immediately inform the BMI Procurement Office of any circumstances and changes that may affect their suitability during the procedure - in particular if this has rendered incorrect the evidence and declarations submitted with the application for participation. The Procurement Office of the BMI enters into a new aptitude test. A subsequent exclusion of the applicant from the bidder pool is also possible.

After expiry of the offer period, the offers will first be formally examined in accordance with §§ 56 ff. VgV. This is followed by an examination of whether a tenderer has the appropriateness necessary for the performance of the individual contract (approval as an environmental verifier or environmental verifier organisation for the NACE code(s) specified in the individual award and self-declaration to avoid conflicts of interest) and does not have to be excluded in accordance with §§ 123 or 124 GWB and Article 5k of Regulation (EU) 833/2014. Finally, the appropriateness of the prices is checked and the most economical offer is determined.

The contract shall be awarded on the most economical tender in accordance with the conditions. In order to determine the most economical tender, the previously announced award criteria are used.

Candidates admitted to the DBS bidding pool are not obliged to submit a tender within the framework of the individual contract awards.
