The subject of the proceedings is the purchase of materials for the repair of road surfaces and partial repairs divided into two parts:
1) Part I - mineral and asphalt mixture of the AC 11S wear layer for mechanical incorporation with overlays on larger surfaces in the amount of 1800 tons, which should be made on the basis of D50/70 asphalt for traffic category KR 1-2 and meet the requirements of the minimum standard. EN 13108-1 or equivalent,
2) Part II - mixture of mineral - asphalt leveling and binding layer AC16W in the amount of 650 tons, which should be made on the basis of asphalt D50/70 for traffic category KR 1-2 and meet the requirements of the minimum standard. EN 13108-1 or equivalent,

1) Part I - mineral and asphalt mixture of the AC 11S wear layer for mechanical incorporation with overlays on larger surfaces in the amount of 1800 tons, which should be made on the basis of D50/70 asphalt for traffic category KR 1-2 and meet the requirements of the minimum standard. EN 13108-1 or equivalent,
Deliveries carried out successively by transport of the Ordering Party according to the current demand.
The above quantities of materials are estimates. The Ordering Party reserves the right to purchase a smaller amount of materials in the event of reasons beyond the control of the Ordering Party (i.e. depending on the number and scope of works performed), provided that this amount will not be less than 1000 tons.
2. Transport of the mineral and asphalt mixture shall be carried out by the Ordering Party successively as needed by the Ordering Party during the term of the contract or until the expected scope of the contract is exhausted, depending on which of the conditions will be met first.
3. The amount of mineral and asphalt mixture to be collected on a given day, the Representative of the Contracting Authority will agree with the Contractor by phone or e-mail, at least one day before the planned collection.
4. The minimum amount of a single ordered (collected) mineral-asflat mixture (applies to parts I and II) – 3 tons.
5. The Supplier shall provide the Ordering Party with the collection of the mineral and asphalt mixture on working days (Monday – Friday) from 7.00 to 15.00.
6. The Contracting Authority requires that the Contractor applying for the award of a contract in Parts I and II has a fully operational Bituminous Mass Plant with a capacity of at least 50 Mg/h, located at a distance of no more than 45 km from the seat of the Contracting Authority (i.e. Baza SPGK Sp. z o.o., Jana Pawła II 59, 38-500 Sanok). The requirement results from technological reasons, i.e. the transport of the mineral and asphalt mixture will be carried out by vehicles with a load capacity of up to 12 tons, with the proviso that, if necessary, the Ordering Party will collect smaller quantities resulting from current needs. Bearing in mind the need to ensure appropriate parameters, in particular the temperature of the mineral-asphalt mixture, before its incorporation specified in the specification of making the surface from mineral and asphalt mixtures, it is necessary to indicate the distance as above. Otherwise, there is a risk that the ordered material will be useless, and the Ordering Party will incur losses related to the purchase of mineral and asphalt mass, transport costs and "downtime" of employees involved in repair works.
7. In the event of a failure of his factory, the Contractor is obliged to indicate another Mass Producer, from whom the Ordering Party will be able to collect the subject of the contract on the terms as in SWZ at the same offered unit price, and the distance of the Manufacturer's factory may not be greater than 45km from the Ordering Party's headquarters. In this case, the settlement of receivables for the received quantity of the subject of the order from another (indicated) Manufacturer will take place between the Ordering Party and the Contractor - and not with the indicated Manufacturer.
8. For the production of asphalt concrete, it is not allowed to use material from milling mineral and bituminous surface as a component material for mineral and asphalt mix.
9. The Contractor undertakes, on the day of receipt for each batch of the received order, to provide the Ordering Party with a document confirming the received quantity of assortment (WZ or weight receipt) with a legible signature of the receiving person authorized by the Ordering Party.
10. The Contractor undertakes to provide a current declaration of conformity or certificate of conformity with the Technical Approval. The contracting authority shall have the right to request current approvals, declarations of conformity or laboratory tests of the subject of the contract at any time during the term of the contract.
