The subject of the contract are services covering the maintenance of tall greenery in the city of Tychy in 2024, divided into five parts, hereinafter referred to as tasks, entitled:
Task No. 1 - Tree care in parks and non-park areas,
Task No. 2 - Maintenance of trees in the road lanes,
Task No. 3 - Tree felling in parks and non-park areas,
Task No. 4 – Felling trees in road lanes
Task No. 5 - Care of young trees in parks, squares and non-park areas as well as in road lanes.
Task No. 1 - Tree care in parks and non-park areasThe material scope of the subject of the contract includes m.in.:
(a) Within the scope of task 1:
- tree care in parks, squares and undeveloped green areas,
- removal of suckers at the base of trees and offshoots from the trunk,
- unveiling of park lighting fixtures,
- removal of fallen and broken trees,
- clearing the area from windbreaks – collecting large branches and limbs after adverse weather conditions (e.g. strong winds),
- grubbing up stumps,
- milling trunks,
- emergency removal of fallen trees and branches hanging on the tree,

The contracting authority requires the contractor or subcontractor to employ on the basis of an employment relationship persons performing all activities in the field of contract performance indicated in the description of the subject of the contract, i.e.:
Task # 1:
1) tree care in parks, squares and urban areas;
(2) removal of offshoots from the trunk and suckers at the base of the trunk;
3) unveiling of park lighting fixtures;
(4) removal of fallen and broken trees;
5) clearing the area of windfall;
(6) grubbing up stumps;
7) stump milling;
8) emergency removal of fallen trees, broken trees and limbs hanging on the tree,
However, a person performing managerial activities under the subject matter of the contract does not have to be employed by a contractor or subcontractor on the basis of an employment relationship.
The method of verifying the employment of these persons and the contracting authority's rights to control the contractor's compliance with the requirements related to employing these persons, as well as sanctions for failure to meet these requirements, are specified in the draft provisions of the contract.
A contractor who relies on equivalent solutions is obliged to demonstrate that the solution offered by it meets the requirements specified by the contracting authority. In this case, the contractor attaches to the tender documents confirming the equivalence of the solutions offered. The burden of proving equivalence shall lie with the economic operator. The contractor demonstrates equivalence by any (reliable) means. Failure to demonstrate equivalence shall result in the tender being rejected as not complying with the terms of the contract.
Task No. 2 - Maintenance of trees in the road lanesThe material scope of the subject of the contract includes m.in.:
(a) within the scope of task 2:
- tree care in road lanes,
- uncovering the gauge,
- unveiling of road signs and signals, as well as street lighting fixtures,
- removal of suckers at the base of trees and offshoots from the trunk,
- removal of fallen and broken trees,
- clearing the area from windbreaks – collecting large branches and limbs after adverse weather conditions (e.g. strong winds),
- grubbing up self-sown plants in road lanes,
- grubbing up stumps,
- milling trunks,
- emergency removal of fallen trees, broken trees and limbs hanging on the tree.

6) clearing the area of windfall;
7) grubbing up self-sown plants in road lanes;
(8) grubbing up stumps;
(9) stump milling;
10) emergency removal of fallen trees, broken trees and branches hanging on the tree,
however, a person performing managerial activities under the subject matter of the contract and a person holding a certificate of completion of training in the performance of certain activities related to road traffic management issued by the Provincial Road Traffic Centre do not have to be employed by a contractor or subcontractor on the basis of an employment relationship.
The method of verifying the employment of these persons and the contracting authority's rights to control the contractor's compliance with the requirements related to employing these persons, as well as sanctions for failure to meet these requirements, are specified in the draft provisions of the contract.

5) preparation of harvested wood for transport to the place indicated by the ordering party;
6) tidying up the place of felling,
