1. The subject of the contract includes the performance of the task entitled: "Green development of the Philadelphia Boulevard - part III".

2. The subject of the contract includes the arrangement of greenery in the area of Bulwar Filadelfijski Street between the walls of the Old Town and the strengthening of the Vistula River embankment, on the section from the J. Piłsudski road bridge to the E. Malinowski railway bridge, through the execution of new plantings of trees, shrubs, perennials, bulbous plants, ornamental grasses, as well as the establishment of lawns and finishing works, on a total area of 33,838 m².

1. The subject of the contract includes the execution of greenery works, including:

1) preparation of designated areas for plantings in accordance with the principles of horticultural art,

2) removal and disposal of waste,

3) planting trees, shrubs, perennials, bulbous plants, ornamental grasses and establishing lawns using the hydroseeding method, in accordance with the principles of gardening art,

4) execution of finishing works (agrotextile, mulching with composted wood chips, pebble surfaces, etc.),

2. The Contractor shall perform the subject matter of the contract within the scope and in the manner specified in the detailed design by Ms. H. Pawłowska and Ms. K. Ostojska and attachments:

1) Appl. No. 1. Scope of the subject matter of the contract – part 3,

2) Appl. No. 2. Executive design – greenery,

3) Appl. No. 3. Annex to the detailed design – development of the boulevard part 3,

forming an integral part of the model contract.

3.. The Contractor is obliged to replace dead or poorly conditioned plants with those free from defects within the warranty period indicated in § 2 section 3 of the contract template.

4.. As part of the contract, the Contractor is also obliged to transport all waste generated in connection with the performance of the subject matter of the contract to a municipal waste landfill. The related costs, including fees for storing waste at the landfill, are borne by the Contractor as part of the remuneration resulting from the concluded contract.

5. A detailed description of the subject matter of the contract and the requirements for the Contractor are included in the model contract (Appendix No. 6 to the Terms of Reference) and annexes to the model contract.

6. The provisions concerning equivalent solutions are contained in point 6 of the Terms of Reference.

7. Deadline for completion of the order - 25 weeks from the date of signing the contract.

8. The Contracting Authority requires the Contractor or subcontractor to employ on the basis of an employment contract persons performing physical activities and operating machines at green works, the performance of which consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – the Labour Code (Journal of Laws of 2022, item 1510). Details of the requirements for employment on the basis of an employment relationship are included in the model agreement attached to the Terms of Reference

9. Tender deposit in the amount of PLN 30,000.00 (say: thirty thousand zlotys)

should be lodged before the deadline for submission of tenders. The validity period of the defect should be in accordance with the date of binding the tender.

The date of the deposit of the defect shall be accepted for the date of its impact on the Ordering Party's

The execution by the executor of the order to make a transfer order cannot be equated with the payment of the amount of the tender deposit by bank transfer to the bank account. Issuance of a transfer order results in the bank taking certain actions aimed at executing the instruction under the conditions specified in the bank account agreement. Therefore, the instruction itself is not equivalent to making a deposit.

Thus, only the appropriate amount on the contracting authority's account as a bid bond determines its payment, and the effective payment of the bid bond will take place when the amount of the bid bond is credited to the contracting authority's account before the deadline for submission of tenders.

(b) bank surety or surety of the cooperative savings and credit bank,

(c) bank guarantees,

(d) insurance guarantees,

e) sureties granted by entities referred to in Article 6b(5)(2) of the Act of

9 November 2000 on the establishment of the Polish Agency for Enterprise Development (i.e. Journal of Laws of 2018,

item 110).

If the defect is brought in the form of a surety or guarantee, the contractor shall forward the original warranty or surety to the contracting authority in electronic form.

10. The provisions concerning the rules for the return of the bid bond are set out in point 16 of the Terms of Reference.
