1. The subject of the contract will be divided into the following PARTS of the order:
1) PART I – successive sale and delivery of unleaded Pb 95 petrol to a petrol station located in the Transport Base of the Warmia and Mazury Voivodship Office in Olsztyn at 16 Kasprzaka Street,
2) PART II – successive sale and delivery of light fuel oil to the building of the Warmia and Mazury Voivodship Office in Olsztyn at 53/55 Niepodległości Street,
3) PART III – successive sale and delivery of unleaded Pb 95 petrol, diesel oil and light fuel oil to border crossings located in the Warmińsko-Mazurskie Voivodeship.
2. The sale and delivery of fuel will take place by transport of the contractor (in the case of heating oil - a tank truck with a pump adapted to transport fuel oil), at the expense and risk of the contractor, the subject of the contract also includes loading of fuel at the manufacturer's terminal, transport and its unloading at the place of destination
Successive sale and delivery of unleaded Pb 95 petrol to a petrol station located in the Transport Base of the Warmia and Mazury Voivodship Office in Olsztyn at 16 Kasprzaka Street.1. Under PART I of the order, successive sale and delivery of unleaded Pb 95 gasoline in the planned quantity of 75,000 l is foreseen.
2. The Contractor shall be obliged to sell and deliver unleaded petrol Pb 95 successively, i.e. in batches of 15,000 l each, the contracting authority allows the possibility of placing an order for the delivery of a batch of unleaded Pb 95 petrol in an amount of less than 15,000 l, but not less than 5,000 l.
3. The quantity of unleaded petrol Pb 95 accepted by the customer is an estimate. The Ordering Party reserves the right to order, during the term of the contract:
1) less fuel, according to its needs, while undertaking to perform the contract at a minimum level of not less than 60% of the total value of the contract concluded as a result of the procedure, subject to point 6,
2) more fuel, according to its needs, provided that this change will not exceed the total value of the contract concluded as a result of the proceedings.
4. Any order during the term of the contract of a smaller or larger quantity of unleaded petrol Pb 95 will not result in a change in the discount/margin given by the contractor in the offer in relation to the price of 1 liter of unleaded petrol Pb 95 applicable at the manufacturer, and for this reason the contractor will not be entitled to any additional claims against the ordering party.
5. The subject of the contract will be divided into the following stages:
1) stage I – covering the performance of the contract in 2024,
2) stage II – covering the performance of the contract in 2025,
3) stage III – including the performance of the contract in 2026,
4) stage IV – covering the performance of the contract in 2027.
6. In the absence of funds for the performance of the subject of the contract under stage I, II, III or IV, the contracting authority will withdraw from the implementation of this / these stages, and in such a case the contractor will be entitled only to remuneration due for the performance of part of the contract until the date of withdrawal.
Successive sale and delivery of light fuel oil to the building of the Warmia and Mazury Voivodship Office in Olsztyn at 53/55 Niepodległości Street.1. Under PART II of the contract, the successive sale and delivery of light fuel oil in the planned quantity of 112,000 l is foreseen.
2. The Contractor shall be obliged to sell and deliver light fuel oil successively, i.e. in batches whose size will be in the range from 7,000 l to 8,000 l each, the contracting authority allows the possibility of placing an order for the delivery of a batch of light fuel oil in an amount of less than 7,000 l, but not less than 4,000 l.
3. The quantity of light fuel oil accepted by the customer is an estimate. The Ordering Party reserves the right to order, during the term of the contract:
1) less fuel, according to its needs, while undertaking to perform the contract at a minimum level of not less than 40% of the total value of the contract concluded as a result of the procedure, subject to point 7,
2) more fuel, according to their needs, provided that these changes will not result in exceeding the total value of the contract concluded as a result of the proceedings.
4. Any order during the term of the contract of a smaller or larger amount of light fuel oil will not result in a change in the discount/margin specified by the contractor in the offer in relation to the price of 1 liter of light fuel oil applicable at the manufacturer, and for this reason the contractor will not be entitled to any additional claims against the contracting authority.
5. The Contractor shall be obliged to sell and deliver light fuel oil that will meet the requirements set out in the tender specifications, hereinafter referred to as SWZ.
6. The subject of the contract will be divided into the following stages:
1) stage I – covering the performance of the contract in 2023,
2) stage II – covering the performance of the contract in 2024,
3) stage III – covering the performance of the contract in 2025,
4) stage IV – covering the performance of the contract in 2026,
5) stage V – covering the performance of the contract in 2027.
7. In the absence of funds for the performance of the subject of the contract under stage II, III, IV or V, the contracting authority shall withdraw from the implementation of this / these stages, and in such a case the contractor will be entitled only to remuneration due for the performance of part of the contract until the date of withdrawal.
Successive sale and delivery of unleaded Pb 95 petrol, diesel oil and light fuel oil to border crossings located in the Warmińsko-Mazurskie Voivodeship.1. Under PART III of the order, the order provides for the successive sale and delivery of Pb 95 gasoline in the planned total quantity of 37,500 l, diesel fuel in the planned total quantity of 85,000 l and light fuel oil in the planned total amount of 2,450,000 l to the following border crossings in NW. the estimated quantity of sales and deliveries, i.e.:
1) Road Border Crossing in Bezledy:
a) unleaded petrol Pb 95 – 14,000 l,
b) diesel fuel – 22,000 l,
c) light fuel oil – 650,000 l,
2) Road Border Crossing in Grzechotki:
a) unleaded petrol Pb 95 – 16,000 l,
b) diesel fuel – 40,000 l,
c) light fuel oil – 1,000,000 l,
3) Road Border Crossing in Gronowo:
a) unleaded petrol Pb 95 – 3,000 l,
b) diesel fuel – 8.000 l,
c) light fuel oil – 280,000 l,
4) Road Border Crossing in Gołdap:
a) unleaded petrol Pb 95 – 4,500 l,
b) diesel fuel – 15.000 l,
c) light fuel oil – 520,000 l.
2. The Contractor shall be obliged to:
1) sale and delivery of unleaded petrol Pb 95 successively, i.e. in batches of 1,000 l, the Ordering Party allows the possibility of placing an order for the delivery of a batch of unleaded Pb 95 petrol in an amount of less than 1,000 l, but not less than 500 l,
2) sale and delivery of diesel oil successively, i.e. in batches of 1,000 l, the Ordering Party allows the possibility of placing an order for the delivery of a batch of diesel oil in an amount of less than 1,000 l, but not less than 500 l,
3) sale and delivery of light fuel oil successively, i.e. in batches whose size will be in the range from 4,000 l to 30,000 l each, depending on the border crossing to which light fuel oil will be delivered, the Ordering Party allows the possibility of placing an order for the delivery of a batch of light fuel oil in an amount of less than 4,000 l, but not less than 1,000 l.
3. The quantities of unleaded petrol Pb 95, diesel oil and light fuel oil accepted by the customer are estimates. The Ordering Party reserves the right to order, during the term of the contract:
1) less fuel, according to its needs, while undertaking to perform the contract at a minimum level of not less than 60% of the total value of the contract concluded as a result of the procedure, subject to point 7,
2) a smaller or larger amount of individual types of fuel, according to their needs, provided that these changes will not result in exceeding the total value of the contract concluded as a result of the proceedings.
4. Any order during the term of the contract of a smaller or larger quantity of unleaded Pb 95 petrol, diesel oil or light heating oil at individual border crossings will not result in a change in the discount/margin given by the contractor in the offer in relation to the price of 1 liter of unleaded Pb 95 petrol, diesel oil and heating oil applicable at the manufacturer, and for this reason the contractor will not be entitled to any additional claims in relation to Contracting authority.
5. The Contractor shall be obliged to sell and deliver light fuel oil that will meet the requirements set out in the SWZ.

1) stage I – covering the performance of the contract in 2023,
2) stage II – covering the performance of the contract in 2024,
3) stage III – covering the performance of the contract in 2025,
4) stage IV – covering the performance of the contract in 2026,

In the absence of funds for the performance of the subject of the contract under stage II, III, IV or V, the contracting authority shall withdraw from the implementation of this / these stages, and in such a case the contractor will be entitled only to remuneration due for the performance of part of the contract until the date of withdrawal.
