Justification: the subject of the contract is a service consisting of a min. collection of hazardous and non-hazardous waste. Pursuant to Article 16 of the Waste Act of 14 December 2012 (Journal of Laws of 2020, item 797 as amended), waste management should be carried out in a way that protects human life and health and the environment. Pursuant to the Act cited above, the Contractor receiving the waste shall become its holder and shall be obliged to deal with it in accordance with applicable law. In view of the above, the obligation of the Contractor's personal performance of the indicated part of the contract shall give the Ordering Party a guarantee of its due performance, and facilitate the supervision and coordination of the service performed. The Contracting Authority provides for the possibility of awarding contracts referred to in Article 214 (1) (7) of the Law Pzp.
The Contracting Authority provides, within 3 years from the date of the award of the basic contract, the possibility of awarding the contract to the existing Contractor, which consists in the after-secondary of similar services in accordance with the subject of the basic contract referred to in Article 214 (1) (7) of the Pzp Act worth up to 100% of the value of the basic order. The mass of waste received by the Contractor shall not exceed the mass of waste given by the Contracting Authority. The weight of waste specified in Annex 2a to the Description of the object of the order may be reduced by a maximum of 20%. The waste mass given is a net weight.
Waste is stored in bulk, thus the Contractor must secure in his own right the replacement packaging for transport. The waste storage site is described in column 6 of Annex No 2a. Weighing, loading and transporting waste will be carried out at the Contractor's expense and his forces.
The Contracting Authority shall allow that the Contractor, who will collect the waste from the place indicated by the Contracting Authority, to independently process the waste received without passing it for processing to another entity.
