The subject of the contract is the supply of traction electricity and the provision of traction energy distribution services under a comprehensive agreement for the purpose of conducting transport activities for the years 2023-2026 with traction vehicles powered from the 3kV DC electric overhead contact line.

The place of supply of electricity is the traction vehicle, with the boundary of the parties in the supply of electricity being located at the ends of the power supplies from the side of the overhead contact line.

The Ordering Party is a Railway Carrier whose Traction Vehicles powered by Traction Energy from the DSO Network are not equipped with metering and billing systems, and thus are settled on the basis of transport work in the Bt21 tariff group. Settlement for the electricity consumed for traction purposes will take place in accordance with the Bt21 tariff group according to the indications of energy meters installed in the Ordering Party's traction vehicles.

Due to the fact that during the performance of the contract, the Contracting Authority's traction vehicles will move around the technical facilities of the Małopolska Railways (i.e. the area equipped with a catenary network powered from a separate one-sided power source, having a metering and settlement system for electricity), the Contractor will be obliged to reduce the amount of energy consumed indicated by the measuring devices on traction vehicles by the amount of energy consumed in the settlement period on in the event that the Technical Facilities will be used only by the Traction Vehicles of the Ordering Party or reducing the amount of energy consumed indicated by the measuring devices on traction vehicles by the amount of energy consumed in the settlement period indicated as consumption by the mentioned vehicles in the Technical Base in the system used to record data on energy consumption belonging to the Ordering Party. The boundaries of the separated area will be determined by the Ordering Party.

The provision of the electricity distribution service will take place in accordance with the provisions of the Tariff for electricity of the Contractor in force for a given settlement period.
