1) The subject of the contract is the execution of construction works related to the construction of gravity and pressure sanitary sewage system with connections and pumping stations in Borek Mielęcki and Szklarka Mielęcka, commune Kępno with a total length of approx. 5.87 km and making a passage under the S8 national road along with the demolition and reconstruction of road surfaces related to the construction of the sewage network in question.
2) Construction works will be carried out in accordance with the Contract Conditions for Construction for engineering and construction works designed by the Employer - 4th English-Polish edition unchanged 2008 - translation of the first edition of FIDIC 1999 (the so-called red FIDIC).

1) The subject of the contract is the execution of construction works related to the construction of gravity and pressure sanitary sewage system with connections and pumping stations in Borek Mielęcki and Szklarka Mielęcka, commune Kępno and making the transition under the S8 national road, covering in its scope:
a) Construction of sanitary sewage system, including:
- gravity sewage system made of PVC 200 pipes with a total length of approx. 3.44 km,
- discharge sewage system made of PE 160 pipes - with a total length of approx. 1.17 km,
- discharge sewage system made of PE 125 pipes - with a total length of approx. 0.56 km,
- discharge sewage system made of PE 110 pipes - with a total length of approx. 0.04 km,
- discharge sewage system made of PE 90 pipes - with a total length of approx. 0.03 km,
- sanitary drains made of PVC pipes 160 - 94 pieces, total length 0.63 km,
- polymer concrete sewage pumping station, together with the power supply installation - 5 sets,
- demolition and reconstruction of road surfaces related to the construction of the sewage network in question.
2) The price of the offer should also include the following scope of works and activities included in the implementation of the contract:
a) organizing the back-up facilities and the construction site together with the OHS and fire safety measures,
b) costs of full geodetic service, including costs of performing geodetic as-built inventory,
c) costs of establishing and performing archaeological supervision over construction works in order to carry out the necessary archaeological and security documentation works,
d) costs of maintaining the construction site, including utilities,
e) development and implementation (execution and assembly) of temporary traffic organization for the duration of construction works, and disassembly of the marking after completion of works, as well as obtaining necessary permits to occupy the road lane and pay the required fees in this respect,
f) carry out all tests, checks and acceptances anticipated in the technical conditions for the acceptance of construction and assembly and installation works as well as those described in SST,
g) technical coordination and supervision (employment of the Site Manager).
h) all costs, including the costs of supervision over the implementation of works resulting from industry arrangements (including collisions with the gas pipeline and teletechnical networks),
i) costs related to the removal of excess material from the cutter (so-called destruct) and material from the demolition of cobblestone to the place indicated by the Ordering Party at a distance of up to 15 km
j) insurance policy for all construction risks (CAR / EAR) in accordance with the conditions specified by the Employer in Annex 1A to the ToR, in Part II of the ToR - Model contract on public procurement and in Chapter 18 of the General Conditions of the Contract
k) photographic documentation of conducted works, especially disappearing works,
l) performing all activities required by law necessary to obtain a permit to use the facility
m) performance of the required warranty inspections during the warranty and guarantee period.
3) The Contractor is obliged to secure roads leading to the construction site against damage caused by means of transport of the Contractor or its Subcontractors
4) The Awarding Entity provides for the requirements referred to in art. 29 paragraph 3a - The Employer requires employment by the Contractor or subcontractor under an employment contract of persons performing activities within the scope of the contract within the meaning of the provisions of the Act of 26.6.1974 - Labor Code (Journal of Laws of 2018, item 917, as amended). d.).
The contracting authority requires that people who perform activities directly related to the performance of works, i.e. manual workers were employed under an employment contract.
