1. The subject of the contract is the delivery of mobile phones for NASK-PIB employees, hereinafter referred to as the "Equipment" or "Device" together with the Contractor's assurance of a warranty.

2. A detailed description of the subject matter of the contract (referred to as SOPZ) is included in Appendix 1 to the Terms of Reference.

1. The subject of the basic contract is:

1) successive delivery to the Ordering Party on the basis of orders placed brand new mobile phones with minimum requirements specified in Chapter IV of the Detailed Description of the Subject of the Contract, constituting Appendix No. 1 to the Terms of Reference-SOPZ, according to the following 2 (two) Groups:

a) Group I – mobile phones – 10 pcs.,

b) Group II – mobile phones – 600 pcs.

2) Provision by the Contractor of a guarantee for the Equipment referred to in point 1) for a period of at least 24 months (Extension of the Equipment warranty period (G) is a criterion for the evaluation of offers referred to in Chapter XV of the SWZ), counted from the date of signing the Unit Order Acceptance Protocol without reservations for a given Unit Order.

2. The subject matter of the contract under the right of option is:

Option 1:

1) successive delivery to the Ordering Party on the basis of orders placed for Equipment with minimum requirements specified in Chapter IV of the SOPZ, according to the following 2 (two) Groups:

a) Group I – mobile phones – 5 pcs.,

b) Group II – mobile phones – 300 pcs, within the deadline for the execution of the order referred to in section 6 below (6 months)

2) Provision by the Contractor of a warranty for the Equipment referred to in point 1) for a period of at least 24 months (Extension of the warranty period of the Equipment (G) is a criterion for the evaluation of offers referred to in Chapter XV of the Terms of Reference), counted from the date of signing the Unit Order Acceptance Protocol without reservations for a given Unit Order

or

Option 2:

3) successive delivery to the Ordering Party on the basis of orders placed for Equipment with minimum requirements specified in Chapter IV of the SOPZ, according to the following 2 (two) Groups:

a) Group I – mobile phones – 5 pcs.,

b) Group II – mobile phones – 300 pcs, within the deadline for the execution of the order referred to in paragraph 6 below, extended by an additional 6 months, i.e.: (12 months)

4) Provision by the Contractor of the warranty for the Equipment referred to in point 1) for a period of at least 24 months (Extension of the warranty period of the Equipment (G) is a criterion for the evaluation of offers referred to in Chapter XV of the Terms of Reference), counted from the date of signing the Unit Order Acceptance Protocol without reservations for a given Unit Order.

3. A detailed description of the subject matter of the contract (referred to as SOPZ) is included in Appendix 1 to the Terms of Reference.

4. The planned estimated number of Equipment, indicated in section 1(1) (under the basic order) and section 2(1) or (3) (under the right of option) above, is the Contracting Authority's assumption as to the expected number of Equipment to be ordered throughout the term of the contract. As part of the performance of the subject matter of the contract, the Contracting Authority shall place individual orders according to its needs and shall not be obliged to submit a unit order referred to in § 7 of the Agreement to the Contractor up to the amount indicated in § 8 section 1 of the Agreement. The Contracting Authority undertakes to use 50% of the maximum remuneration referred to in §8 section 1 point 1) of the Agreement (i.e. the guaranteed amount).

5. The deadline for the execution of the order is 6 months, counted from the date of conclusion of the Agreement, with the proviso that the Equipment will be delivered to the Ordering Party successively, on the basis of individual Orders referred to in § 7 section 1 of Appendix No. 7 to the Terms of Reference-model Agreement, hereinafter referred to as the "Agreement", subject to the possibility of exercising the right of option referred to in § 2 section 4 et seq. Agreement and in Chapter IV, Section 4 below, i.e.: Option No. 1 (Option No. 1 is in the contract performance period, i.e. within 6 months) or Option No. 2 (Option No. 2 is extended by an additional 6 months, i.e. 12 months). The deadlines for the completion of individual Orders will be indicated each time in the individual Order form, taking into account § 7 section 1 point 2) of the Agreement.
