The subject of the Order is:

1) Provision of development services for dedicated software owned by the Ordering Party;

2) Creating and implementing new dedicated software;

3) Provision of maintenance and service support services for dedicated software owned by the Ordering Party;

4) Provision of maintenance and service support services for software developed/modified by the Contractor for the needs of the CPK;

5) Granting a quality guarantee for a period of 12 months from the date of the acceptance protocol signed without reservations.

I. The subject of the order is:

1) Provision of the Development Service for dedicated software owned by the Contracting Authority based on Microsoft and Java technology during the term of the agreement for a period not longer than 36 months from the date of protocol takeover of the provision of the Services;

2) Creation and implementation of new dedicated software based on any technology, subject to its acceptance by the Ordering Party, for a period of 36 months from the date of signing the Agreement;

3) Provision of maintenance and service support services for dedicated software owned by the Contracting Party, based on Microsoft and Java technologies, during the term of the agreement for a period not longer than 36 months from the date of protocol takeover of the provision of Services;

4) Provision of maintenance and service support services for software developed/modified by the Contractor for the purposes of the CPK during the term of the agreement for a period not longer than 36 months from the date of protocol takeover of the provision of Services;

5) Granting a quality guarantee for a period of 12 months from the date of the acceptance protocol signed without reservations.

II. The detailed scope of the subject matter of the Contract is included in the OPZ, constituting Appendix No. 1 to the Terms of Reference.

III. The Contracting Authority provides for the award of contracts referred to in Article 388(2)(c) of the Public Procurement Law (hereinafter: Similar Contracts) with respect to:

1) provision of the Development Service for the Dedicated Software owned by the Contracting Party;

2) creating and implementing new Dedicated Software based on any technology, subject to its acceptance by the Ordering Party;

3) providing maintenance and service support services for the Dedicated Software owned by the Contracting Party;

4) providing maintenance and maintenance support services for all Works created/modified by the Contractor for the needs of the Contracting Authority,

the total value of which will not exceed 42% of the net value of the Order.

The Contracting Authority shall award the contract referred to in Article 388(2)(c) of the Public Procurement Law on terms and conditions similar to those set out in the Draft Agreement, constituting Appendix No. 2 to the Terms of Reference, with the proviso that the amount of contractual penalties specified as a percentage will be calculated accordingly from the value of the Similar Contract and all issues relevant to the specificity and scope of the performance of the Similar Contract will be negotiated.

IV. The Contracting Authority requires that the Order be executed within 36 months from the date of conclusion or until the remuneration limit is exhausted. Detailed deadlines for the performance of the subject matter of the Contract are specified in the OPZ or the Draft Agreement.
