1. The subject of the contract is the delivery of servers with software, network devices and an uninterruptible power supply (UPS) for the needs of the Władysław Strzemiński Academy of Fine Arts in Łódź.
2. A detailed description of the subject of the contract, technical parameters of the equipment, description of the requirements of the contracting authority in the scope of implementation and acceptance are specified in Annexes No. 1A, 1B, 1C and 1D to the SWZ and the draft provisions of the contract – Annex No. 6 to the SWZ.
3. The technical parameters given in Annexes 1A, 1B, 1C, 1D to the SWZ are minimum requirements.
1. The subject of the order is the delivery of servers with software, network devices and an uninterruptible power supply (UPS) for the needs of the Academy of Fine Arts

2. A detailed description of the subject of the contract, technical parameters of the equipment, description of the requirements of the contracting authority in the scope of implementation and acceptance are specified in Annexes No. 1A, 1B, 1C and 1D to the SWZ and the draft provisions of the contract – Annex No. 6 to the SWZ.
3. The technical parameters given in Annexes 1A, 1B, 1C and 1D to the SWZ are minimum requirements, which means that the Contractor may offer models that comply with the minimum requirements or models with more efficient processors (while maintaining technology), more RAM, larger HDD, more I/O ports (of a given type), no shorter warranty, etc.
4. The contractor may submit one bid in the procedure in question. To be valid, the tender must include all the items indicated in Annexes 1A, 1B, 1C and 1D
to SWZ. The contracting authority does not allow the submission of bids for individual items as part of the procedure.
5. The description of the item of the order should be read along with any changes to the content of the specification, which are, for example, the result of responses to contractors” queries.
6. All requirements set out in the documents indicated above constitute minimum requirements and fulfilment shall be obligatory. Failure to comply with the minimum requirements will result in the rejection of the offer as incompatible with the terms of the contract pursuant to Article 226 (1) (5) of the Law Pzp.
7. The offered item of the order will be complete and ready for use after installation without any additional purchases or investments on the Ordering Party.
8. The Contractor declares that the delivered object of the order will be factory new, unreconditioned and free from factory and legal defects and that he has all the legal certificates and certificates required.
9. The delivered item of the order shall not be older than six months from the date of manufacture of the equipment.
10. Delivery of the item of the order will be at the expense and risk of the Contractor.
11. The Ordering Party requires that the offered subject of the contract meets the requirements set out in the applicable Polish law as well as the law of the European Union, has been admitted to trading and has valid documents required by law, confirming admission to use in the EU, as well as meet other requirements (standards, parameters) specified by the Ordering Party in the SWZ.
12. The subject of delivery must comply with the requirements of Polish standards carrying European harmonised standards or, in the absence of them, European technical approvals, common technical specifications, Polish standards transferring European standards, Polish standards introducing standards international, Polish standards, Polish technical approvals.
13. The Contractor is obliged to clearly define the offered products by indicating, among others, the manufacturer, the model of the offered product in the price form of Annex 2 to the SWZ.
14. A security shall be required in the proceedings in question. The deposit is set at PLN 18,000.00. (eighteen thousand zlotys). Details of the bid bond are described in SWZ.
14. Required warranty period for the delivered subject of the contract: Server – 84 months, Backup Server – 84 months, Switches – limited lifetime manufacturer's warranty (5 years), at least one year warranty service for the equipment. UPS – 24 months.
The required warranty period for the delivered subject of the contract – 24 months.
The warranty period begins from the date of signing the acceptance protocol of the subject of the contract.
15. Under Article 83(1)(26) of the Law on value added tax, a tax rate of 0% must be applied to the supply of servers and switches (network switches) required in the present proceedings. The confirmation of the Ministry of Culture and National Heritage about the possibility of applying a 0% VAT rate will be forwarded to the Contractor whose offer will be selected as the most advantageous.
