The subject of the contract is the property and civil liability insurance service and casco insurance of rail vehicles of Tramwaje Śląskie S.A. in accordance with the specified scope of insurance cover for the period from 01.04.2023 to 31.03.2026.
A. PROPERTY INSURANCE AGAINST ALL RISKS-ALL RISKS.
Subject of insurance. The subject of insurance is property owned (independent or dependent) by the Ordering Party during the insurance period (also property into which the Ordering Party / Insured will come into possession during the term of the insurance contract) and other property according to SWZ.
The insurance covers property regardless of age, degree of depreciation and actual wear, date of admission to the register of fixed assets or documentation of possession.
B. Liability insurance for business and property held.
Subject of insurance:
1. The subject of the insurance is civil liability related to the conduct of business, possession of property and performance of statutory tasks by Tramwaje Śląskie S.A.
2. Civil liability insurance covers tortious and/or contractual liability (including damage resulting from non-performance or improper performance of an obligation), as well as concurrence liability (tort-contractual) and civil liability for the product of the Insured, for personal injury (including compensation), property damage and pure financial losses, including consequential damages (understood as lost profits) caused in connection with conducted activity and/or owned, used, administered or managed on the basis of any legal title or legal title m.in.: ownership, rental, lease, leasing, lending, independent possession of own and external property, as well as property constituting the property of the Insured transferred in particular in management, administration, use, care or control, if the Ordering Party / Insured is obliged under the law to repair the victim of the damage suffered by him.
C. Casco insurance of rail vehicles
1. The subject of the insurance shall be rail vehicles owned by the Ordering Party or owned by the Ordering Party or which the Ordering Party will acquire during the term of the Agreement.
The insurance covers property regardless of age, degree of depreciation and actual wear. New rail vehicles will be protected at the time of delivery of new rolling stock in accordance with the content of clause II. point 3.2 of the Description of the subject of the contract.
