1. The subject of the contract is the delivery, installation and commissioning of gas chromatographs with a flame-ionization detector FID (6 sets), gas chromatographs with a mass quadrupole detector (4 sets) and conducting training in the use of delivered chromatographs, divided into Task No. 1 and 2

1) Task No. 1 – Delivery, installation and commissioning of GC-FID chromatographs (6 sets) and conducting training in the use of delivered chromatographs

2) Task No. 2 – Delivery, installation and commissioning of GCMS chromatographs (4 sets) and conducting training in the use of delivered chromatographs

The offer must be accompanied by:

Offer form, means of proof in question, Power of attorney, Statement of contractors jointly applying for the award of the contract referred to in Article 117(4) of the Act, Statement REGARDING THE GROUNDS FOR EXCLUSION UNDER ARTICLE 5K OF THE REGULATION 833/2014 AND ARTICLE 7(1) OF THE ACT..., DOCUMENT CONFIRMING THE SECURITY OF THE BID BOND

Delivery, installation and commissioning of GC-FID chromatographs (6 sets) and conducting training in the use of delivered chromatographs

Task No. 1 – Delivery, installation and commissioning of GC-FID chromatographs (6 sets) and conducting training in the use of delivered chromatographs

General requirements:

1) The Ordering Party demands that the delivered equipment and the attached (necessary for start-up) equipment be brand new, not used, ready for use.

2) The period of the guarantee granted by the Contractor may not be shorter than 24 months.

A detailed description of the subject of the contract is included in:

a) The detailed number and location of the subject of the contract

b) Draft provisions of the contract

c) Description of the subject of the contract

d) Warranty requirements

Any proper names, trademarks, patents, origins, sources or specific processes given in the descriptions, which characterize products or services, standards, technical assessments, technical specifications, etc. are not intended to infringe Art. 99, Article 101, Article 16 of the Act of 11 September 2019. Public procurement law (i.e. Journal of Laws of 2022, item 1710, as amended), and are only intended to specify the quality, technological, performance or functional expectations of the ordering party.

The parameters of equivalence of the main elements of the subject of the contract, which the contracting authority will take into account when assessing equivalence, are specified in the description of the subject of the contract for individual tasks.

The contracting authority will assess compliance with the equivalence condition on the basis of the evidence submitted by the contractor.

To confirm that the offered supplies meet the requirements specified by the contracting authority, the contractor is obliged to attach to the tender:

1) technical specification of the chromatograph (in Polish or English) for the basic elements included in the set: chromatograph, spectrometer, computer, printer;

2) the Contractor's statement that the equipment proposed by him meets all the requirements / parameters specified by the Contracting Authority in the Description of the Subject of the Contract;

3. a certificate from the manufacturer that the contractor is an authorised representative of the manufacturer of the chromatographs offered;

4) CE certificate of conformity attesting to the compliance of the supplied equipment with European safety conditions;

5) the contractor's statement that the connection and commissioning of the equipment will be made by the authorized service of the Manufacturer;

6) the contractor's statement that the manufacturer of the delivered equipment has an authorized warranty and post-warranty service based in Poland. In the statement, the Contractor must provide the name, address and telephone number of the authorized service;

7) a statement of the contractor that guarantees the availability of spare parts for a minimum period of 10 years from the date of purchase of the equipment

8. if an equivalent chromatography column is offered, the Contractor must submit a statement of equivalence of the offered column, indicating in this declaration the technical characteristics of the offered column. The contracting authority will check the equivalence of the offered column by comparing the technical parameters of the offered column with the requirements – it concerns tasks 1 and 2.

2. If the contractor does not submit the evidence in question together with the bid or the evidence submitted is incomplete, the contracting authority shall request the contractor to submit or supplement them within the prescribed period.

3. Such evidence in a foreign language shall be accompanied by a translation into Polish. The Ordering Party allows the possibility of submitting the technical specification of the chromatograph for the basic elements included in the set: chromatograph, spectrometer, computer, printer (indicated in Chapter V. point 1 point 1 SWZ) in English without translation into Polish.

Task No. 2 – Delivery, installation and commissioning of GCMS chromatographs (4 sets) and conducting training in the use of delivered chromatographs

General requirements:

1) The Ordering Party demands that the delivered equipment and the attached (necessary for start-up) equipment be brand new, not used, ready for use.

2) The period of the guarantee granted by the Contractor may not be shorter than 24 months

a) The detailed number and location of the subject of the contract

The Ordering Party requests the payment of the following:

Task No. 1 - deposit amount PLN 6,366.00

Task No. 2 - deposit amount PLN 13,087.00

1. Wadium shall be lodged before the deadline for submitting tenders.

2. The tendering security may be lodged in one or more of the following forms:

1) money

2) bank guarantees

3) insurance guarantees

4) sureties granted by entities referred to in Article 6b(5)(2) of the Act of 9 November 2000 on the establishment of the Polish Agency for Enterprise Development (Journal of Laws of 2020, item 299)

3. The deposit in the form of money should be paid by bank transfer to the bank account number 49 1010 1010 0022 1913 9120 0000 with the note "Deposit – procedure number 13/23 - task number ..."

The Contracting Authority shall allow a defect to be lodged on one document for all tasks, and the tasks and corresponding quotas shall be listed on the document.

NOTE: The deadline for the payment of the defect in the form of money will be the time limit for the recognition of the Ordering Party's account.

4. The vadium brought in the form of a guarantee or surety referred to in point 2 (4) shall be made as the original warranty or surety in electronic form and meet at least the following requirements:

1. It must include responsibility for all cases resulting in loss of defect by the Contractor set out in the Law of the PZP;

2) from its content should be clearly the undertaking of the guarantor to pay the entire amount of the wad;

3) should be irrevocable and unconditional and payable at first request;

4) the term for the surety or warranty shall not be less than the time limit for tying the tender (subject to the first day of tying the offer is the date of submission of tenders);

5. The contents of the surety or warranty should include the name and number of the proceedings concerned;

(6) the beneficiary of the surety or guarantee is: ...

7) in the case of Contractors jointly applying for the award of a contract (Article 58 of the PZP), the Contracting Authority shall require that the surety or warranty shall cover by its content (i.e. obligated for surety or warranty) of all Contractors jointly applying for the award of the contract or to its content has resulted in securing the offer of Contractors jointly applying for the award of the contract (consortium);

5. Offer by a contractor who has not brought the defect, or brought the defect incorrectly or has not maintained the defect continuously until the deadline for binding the tender or applied for reimbursement of the defecium in the case referred to in Article 98 (2) (3) of the PZP is rejected.

6. Claims may be filed within the specified period after the expiry of its validity period, if only the event justifying the retention of the bid bond took place before the expiry of the bid validity period.

7. The contracting authority shall return the bid bond on the terms set out in Article 98(1)-(5) of the PPL.

8. The contracting authority shall retain the bid bond together with interest in the cases specified in Article 98(6) of the PPL.
