"Purification of the Libiąż Commune in 2023"

1. The subject of the contract is the performance of the service "Purification of the Libiąż Commune in 2023.

2. The order is divided into three parts.

1) Part I. – Winter maintenance in the city of Libiąża.

2) Part II. – Winter maintenance in the area of Żarki and Gromiec villages

3) Part III. – Post-winter and summer cleaning of roads, sidewalks, squares /parking lots, emptying street baskets and other works related to the cleaning of the area of the Libiąż commune.

4. Detailed descriptions of the subject of the contract divided into lots are described in the annexes:

- No. 12.1. to the SWZ for Part I. of the order,

- No. 12.2. to the SWZ for Part II of the order,

- No. 12.3. to the SWZ for Part III. of the order.

5. The quality requirements for the purification service of the Libiąż Commune are presented in the detailed descriptions of the subject of the contract, referred to in point No. 4.

6. The Contracting Authority provides for requirements for the employment of persons referred to in Article 95 of the PPL Act, in accordance with the provisions of Chapter III of the SWZ.

Part I. – Winter maintenance in the city of Libiąża.

1. The subject of the contract is the performance of the service "Purification of the Libiąż Commune in 2023.

2. The order is divided into three parts.

1) Part I. – Winter maintenance in the city of Libiąża.

The subject of the contract is the performance of winter maintenance services for roads, sidewalks, squares, parking lots in the city of Libiąż, by:

- removal of snow from the roadway, sidewalks, squares, parking lots, including the de-rinsing of the roadway along its entire width along with bus bays;

- snow removal of intersections (in such a way as not to hinder joining the snow-cleared road from adjacent roads);

- sprinkling roads on driveways, intersections (ensuring road safety);

- combating winter slipperiness;

- snow removal to undeveloped areas (expected amount of 80 m3);

- arrangement of 12 pcs. containers with sand in places most at risk for vehicular traffic (at hills).

For Part I. and for Part II. of the order, winter maintenance services shall be ready to remove the effects of winter 24 hours a day (during periods requiring winter maintenance). Mechanical equipment must be technically efficient and should be available around the clock in the area of service provision, it should be adapted to the width of the roads.

3. Planned quantities (frequency of service) are estimates and are subject to change (decrease

or increase) depending on weather conditions and the actual needs of the subject of the contract. Settlement of the services provided will take place on the basis of the offered unit prices included in the offer and the services actually performed up to the amount of funds allocated for this purpose specified in the contract.

6. Employment requirements on the basis of an employment relationship, in the circumstances referred to in Article 95 of the PPL Act

1) Pursuant to Article 95(1) of the Public Procurement Law, the Contracting Authority requires

employment by the Contractor or Subcontractor on the basis of an employment relationship of persons performing all activities included in the so-called direct costs related to the purification of the municipality in the scope of the performance of the contract, if the performance of these activities consists in performing works in the manner specified in Article 22 § 1 of the Act of 26 June 1974. Labour Code (i.e. Journal of Laws of 2022, item 1510, as amended). The employment requirement applies only to persons who perform activities directly related to the performance of works covered by this contract, i.e. so-called manual workers, unless they are (will be) performed by a given person as part of his business activity.

2) Employment of employees on the basis of an employment relationship should last for the entire duration of the service.

3) During the performance of the contract at each stage of work, the Ordering Party is entitled to perform control activities towards the Contractor or Subcontractor regarding the fulfillment by the Contractor or Subcontractor of the requirement to employ persons performing the persons indicated in point 6 point on the basis of an employment contract. 1) activities. The Ordering Party is entitled in particular to:

a) request statements and documents in the scope of confirming compliance with the above-mentioned requirements and assessing them,

b) request explanations in case of doubts regarding the confirmation of compliance with the above-mentioned requirements,

(c) carry out an on-site inspection.

4) Provisions on the method of documenting employment and checking the Contractor's or Subcontractor's compliance with the requirements for employment under an employment contract and provisions regarding sanctions for non-compliance with the requirements referred to in Article 95(1) of the PPL Act and in the procurement documents, are specified in the Draft Provisions of the Contract – Contract For Part I._za ł.nr 11.1 to SWZ

Part II. – Winter maintenance in the area of żarki and Gromiec villages

1. The subject of the contract is the performance of the service "Purification of the Libiąż Commune in 2023.

The subject of the contract is the performance of winter maintenance services for roads, sidewalks, squares, parking lots in the villages of Żarki and Gromiec, through:

- removal of snow from the roadway, sidewalks, squares, parking lots, including the de-rinsing of the roadway along its entire width along with bus bays;

- snow removal of intersections (in such a way as not to hinder joining the snow-cleared road from adjacent roads);

- sprinkling roads on driveways, intersections (ensuring road safety);

- snow removal to undeveloped areas (expected amount of 20 m3);

Part III. – Post-winter and summer cleaning of roads, sidewalks, squares /parking lots, emptying street baskets and other works related to the cleaning of the area of the Libiąż commune.

1. The subject of the contract is the performance of the service "Purification of the Libiąż Commune in 2023.

2. The order is divided into three parts.

3) Part III. – Post-winter and summer cleaning of roads, sidewalks, squares /parking lots,

emptying street baskets and other works related to the cleaning of the area of the Libiąż commune.

The subject of the contract includes:

- Clearing of land on 1 January 2023

As part of the task, manual collection of waste and cleaning of designated areas is envisaged;

- Post-winter cleaning of roads, sidewalks, squares, parking lots and stairs.

The purpose of post-winter cleaning is to completely remove all impurities accumulated on the surface of the above-mentioned facilities in the winter season. It is envisaged to perform the task by the combined method (manually and mechanically); as a result of the provision of the service, waste with the code: 20 03 03 (waste from cleaning streets and squares) is collected;

- Summer cleaning of roads, sidewalks, squares, parking lots and stairs.

It is envisaged to perform the task with a certain frequency in the summer season, cyclically on designated objects, using the combined method (manually and mechanically); as a result of the provision of the service, waste with the code: 20 03 03 (waste from cleaning streets and squares) is collected;

- Emptying street bins in the municipality.

Manual task. Emptying the bins by loading waste from the bins into bags and loading the bags directly onto the means of transport (bags cannot be collected at pedestrian and street routes); as a result of the provision of the service, waste with the code: 20 03 01 (non-segregated, mixed municipal waste) is collected;

- Collection of garbage from municipal areas.

Mechanical equipment, i.e. street and pavement sweepers and a car for loading waste from street bins and any other waste from cleaning should be technically efficient and should not cause damage to road surfaces, sidewalks, parking lots, squares and should not pose a threat to road users. The Contractor is responsible for damages (e.g. deformation of pavement surfaces, paving stones as a result of the use of inappropriate equipment).

Settlement of the services provided will take place on the basis of the offered unit prices included in the offer and the services actually performed up to the amount of funds allocated for this purpose specified in the contract.

Provisions concerning the method of documenting employment and controlling the Contractor's or Subcontractor's compliance with the requirements for employment under an employment contract and provisions regarding sanctions for non-compliance with the requirements referred to in Article 95(1) of the PPL Act and in the procurement documents are specified in the Draft Provisions of the Contract – Contract for Part III of the Contract (Annex 11.3 to the SWZ).
