Open procedure with document reversal for the contract for the management of the thaw salt spreading service – seasons 2023/2024-2024/2025- Roads managed by the Province of Lucca – Framework Agreement pursuant to art. 154 of Legislative Decree 36/2023, divided into 7 Lots. Garfagnana I

The interventions to be carried out (non-exhaustive list) to be carried out on the entire road network managed by the Province of Lucca, with interventions also limited and of limited entity, can be summarized as follows:

1. Spreading of antifreeze salt, through the use of automated salt spreader, only in areas where ice or frost is found on the road platform such as to compromise the transitability of the road safely even by adopting normal diligence on the part of the drivers of the vehicles. Where appropriate, the vehicle must be duly approved for the processing in question; 2. Elimination of obstacles on the roadway or imminent dangers, such as fallen or visibly dangerous trees to affect the passage of the vehicle, stones of such dimensions that they can be removed with the equipment in possession (non-removable dangers must be adequately marked with road signs, etc.), cleaning of obstructed backpacks so as to avoid that the leakage of water involves the risk of formation of ice plates. The Competitor must be under penalty of exclusion, in possession of the general requirements of Article 94-95 of the Code; Registration in the Register of Companies or in the Register of Artisan Companies for similar services consistent with those covered by this tender procedure and make further declarations pursuant to art. 16 of the Race Regulations. The economic value of the framework agreement does not constitute an indication of contractual consideration, but quantifies a presumed need; in fact, the Framework Agreement pursuant to Article 59 of Legislative Decree 36/2023 constitutes a contractual instrument for the regulation of the stipulation of any and future "implementation contracts" that will be entrusted by the Contracting Authority during the duration of the framework agreement, based on the needs and priorities identified by the Administration. Therefore, the stipulation of the framework agreement with the winning company is not a source of immediate obligation, nor binding with regard to the award of "implementation contracts"; the latter take the form of Service Orders (SO) and are intended to be entrusted with their receipt by the winning company; each SO will describe the intervention and establish the amount, the start date and the maximum completion date.
