1) The subject of the contract are services consisting in performing the Investor's Supervision within the meaning of the construction law over deliveries with assembly of 6 pcs. electronic SDIP boards and 6 pcs. monitoring cameras for the "Reconstruction of the Dynamic Passenger Information System and the expansion of the City Monitoring System" for the project entitled "Sustainable urban transport system in Gorzów Wielkopolski."
2) The Investor's Supervision service is understood as a service provided by a team of specialists representing the Ordering Party in a manner consistent with the provisions of the contract, OPZ and SWZ.
3) The scope of the contract includes performing for the Ordering Party the function of Investor's Supervision consisting in the provision of supervision services, control over the implementation of deliveries with assembly, reporting and task settlement. The Investor's Supervision is obliged to perform all factual and legal activities belonging to the Ordering Party related to the implementation of the above-mentioned task.
1. The subject of the contract is to perform the function of Investor Supervision, including in particular:
1) performing the function of an investor's supervision inspector, and acting as a coordinator of industry activities of investor's supervision inspectors, in accordance with the provisions of Polish law, in particular the Construction Law,
2) management and administration of the supply contract with assembly;
3) monitoring the progress of the supply contract with assembly, including reporting, taking into account the following indicators: material and financial, the form of the Reports should be consistent with the recommendations of the Implementing Authority and agreed with the Contracting Authority;
4) exercising professional and competent investor's supervision over works;
5) supervision of partial and final acceptances;
6) ensuring compliance with and application of Polish construction law by Contractors Suppliers;
7. ensuring that the completed works comply with the technical and formal requirements of the supply/works contracts;
8) material and financial settlement of supply/works contracts;
2. Provision of technical assistance, including in particular:
1) getting acquainted with the technical documentation of the Supplier's Contractor. Submitting comments to the received documentation within 2 weeks from the date of its submission by the Ordering Party;
2) analysing and suggesting any changes in designs and specifications or other documents that may prove necessary or desirable during or after the performance of the Contract with the Contractor Supplier;
3) supervision and control over the proper and timely implementation of investments in accordance with the regulations, including the rules and guidelines for the project co-financed by the European Union Operational Programme Infrastructure and Environment 2014-2020, Priority VI Development of low-emission public transport in cities, Measure 6.1 Development of public transport in cities.
4) preparation and completion of documents necessary for settlement with co-financing entities;
3. Other necessary actions for the proper and timely implementation of the Project.
4. The duties of the Investor's Supervision will include in particular:
Giving opinions on each amendment to the contract included in the subject of the contract. In particular, the Contractor's obligations in this respect will also include the initiation by the Investor's Supervision of any amendment to the contract for delivery with assembly by submitting an appropriate application containing factual and legal justification. The application is submitted to the Ordering Party in paper and electronic versions (the Ordering Party allows sending an electronic version via e-mail).
