Framework agreement (max. 2 years) for the procurement of approx. 3,500 water meters
The client is the Hessian municipality of Wölfersheim.
It intends to purchase approximately 3,500 water meters for municipal use by concluding a framework agreement with a company.
1. Framework agreement
The framework agreement is concluded over an initial period of 1 year. The framework agreement is extended for another year unless it is terminated in writing by the client (AG) or the contractor (AN) at least one month before the end of the initial term. The framework agreement ends after 2 years at the latest, without the need for termination. The unit prices offered by the AN are binding over the possible total term of 2 years.
The expected start of the framework agreement is 31.05.2022. The delivery services described below with the standard prices offered by the contractor would therefore be binding until 31.12.2023 (if the contract was started later, the end of the term will be postponed accordingly). The date on which the individual order is placed is decisive for the contractual commitment, not the delivery date.
Based on current knowledge, the quantities specified in the service specifications represent the client's estimated needs over the above-mentioned maximum total service life. In connection with the standard prices to be specified, this results in the expected order volume. The number of pieces, and therefore also the order volume in terms of numbers, is not finally determined.
The maximum value of this framework agreement is €300,000 net.
The delivery service offered by the bidder includes the delivery of the products described in the individual items to the client's storage location:

The products are released in single orders. After the client has placed the individual order, the products are to be delivered in the quantity specified in the individual order within 4 weeks. A delivery in partial batches per individual order is to be agreed with the client.
Freight and delivery costs as well as packaging and insurance costs of the contractor (contractor) are not remunerated separately and must be included in the unit prices accordingly.
The maximum delivery time per order is 8 weeks. If the delivery period is exceeded, the client has an extraordinary right to terminate the framework agreement.
In this case, the contractor is no longer entitled to have the client accept the ordered goods (individual order). Furthermore, there is no longer any claim to compensation for the delivery that has not been received or any other claims (damages, lost profits, etc.).
Furthermore, after the extraordinary termination, there is no longer any claim to the continuation of the framework agreement or to any other claims (compensation for damages, lost profits, etc.).
The statutory. Fees for the MID declaration of conformity (conformity fee/formerly calibration fees) must be shown separately in the respective unit prices and entered by the bidder accordingly. If I change the compliance fee during the term of the framework agreement, the Conformity fee may be adjusted accordingly by the contractor and the difference may be passed on to the Client.
2. Hygienic safety
A confirmation (self-declaration) of the hygienic safety of the product must be presented with the offer. Alternatively, a corresponding concept from the manufacturer can be presented, which aims to exclude bacteria that are harmful to human health to a harmful extent.
It must also be confirmed that the requirements of Section 17 of the Drinking Water Ordinance are met for the materials and materials used.
If these confirmations are missing when the tender is submitted, they can be requested by the awarding authority with a deadline. If the confirmations are still not available after the deadline, the offer will be excluded from further evaluation.
The stated requirements must be met over the entire contract period and reconfirmed at the client's request.
The AG reserves the right to have deliveries microbiologically examined by an accredited institute immediately after receipt of goods. If there is a finding on Pseudomonas aeruginosa or a finding that microbiological parameters have been exceeded in accordance with the Drinking Water Ordinance, the client reserves the right to return the goods to the Contractor due to defects.
3. Notes on additional product requirements
If the individual items of the list of services contain “further requirements” for the product, which must be proven by proofs, certificates, etc. (e.g. approved according to DVGW worksheet W 270, etc.), the corresponding proofs, certificates, etc. must be attached to the offer.
If this information is missing when the tender is submitted, it may be requested by the awarding authority subject to a deadline. If the information is still not available after the deadline, the offer will be excluded from further evaluation.
4. Information about the bidder information
The water meters are to be delivered with approval according to MID (DIRECTIVE 2014/32/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of February 26, 2014).
The product names of the brands offered by the bidder must be entered in the prepared text field “Offered make” under bidder details in the items of the service specifications.
If the bidder information for the brand being offered is missing at this point when the offer is submitted, the offer will be excluded from further evaluation.
The products offered must also be accompanied by a data sheet, which contains the following values as a minimum specification:
- Q1, Q2, Q3, Q4
- flow ratio Q3/Q1
- starting value
- pressure drop at Q3
- pressure drop at Q4
