1. The subject of the contract is the provision of care services at the place of residence for mentees, hereinafter referred to as “Services”, as defined in the Act of 12 March 2004 on social assistance (item 2268 as amended), including:
1) The order was divided into two parts. Each Contractor may submit a bid for up to one part of the order from among the following:
(a) Part 1 — DOPS District No. 1 — the order includes the implementation of Services in the following districts of Gdynia: Redłowo, Orłowo, Karwiny, Dąbrowa, Mały Kack, Wielki Kack, Part of St. Maximilian Hill, Wiczlino in a dimension of up to 72 000 hours during the duration of the contract;
b) Part 2 — DOPS district No. 3 — the order includes the implementation of Services in the following districts of Gdynia: Grabówek, Leszczynki, Chylonia, Pustki Cisowskie, Demptowo, Cisowa in a maximum dimension of 75,000 hours during the duration of the contract.
Part 1 — DOPS Division No 1Services for Part 1 will be provided at a maximum of 72,000 hours during the duration of the contract, including an estimated number of hours in 2022 — 37,600 hours, while in 2023 —
This number of hours is accepted for the calculation of the offer price.
Whereas under the terms of the dimension of the hours of provision of the Services, only the actual time of provision of the Services should be understood. The contracting person understands the clock hour i.e. 60 minutes.
The Contracting Authority reserves the opportunity to reduce the expected dimension of the hours provided by the Services in each part of the contract, in particular depending on the number of applicants for a given form of aid. The number of hours of the Services indicated above is max, while the minimum dimension of the hours provided for the Services during the period of completion of the subject of the order is: Part 1 — 49 200 hours. Detailed information on the subject matter of the order and the method of its execution is determined by the number 1 to SWZ - Gdyński standard care services provided at the place of residence.
Pursuant to Article 95 (1) of Article 29 (3a) of the Pzp Act, the Contracting Authority requires employment by the Contractor or subcontractor on the basis of an employment contract within the meaning of the Act of 26 June 1974 the Labor Code of persons carrying out the execution of the contract, i.e. persons performing the service in the nature of guardians (not applicable to coordinators), if they fall within the scope of Article 22 (1) of the Labour Code, which reads: “By establishing an employment relationship, the employee undertakes to perform work of a certain type for the benefit of the employer and under his leadership and at the place and time appointed by the employer and the employer to hire an employee for remuneration”. The Contracting Authority considers that the performance of the activities described in § 5 of the Standard consists in carrying out the work in the manner set out in Article 22 (1) of the Act of 26 June 1974 — Labor Code. The details of this condition are indicated in the SWZ, and the powers of the Contracting Authority in respect of non-compliance with the requirements set out in that condition have been regulated in draft contract No. 2 to SWZ.
The description of the subject of the contract is also specified in the model contract, which is Annex 2 to the SWZ. The Contracting Authority does not reserve the obligation to personally perform key parts of the order by the Contractor. The Contractor may entrust the execution of part of the subcontractor's order In such a situation, the Contracting Authority shall require the Contractor to indicate the parts of the contract, the execution of which it intends to entrust to the Subcontractors and provide by the Contractor the names of the Subcontractors (where known). The Contracting Authority shall not reserve the possibility of applying for the contract only by the Contractors referred to in Article 94 of the Pzp Act. The Contracting Authority does not provide for the Contractor's obligation to perform a local vision and check by the Contractor of the documents necessary for the execution of the order available on site with the Contracting The Contracting Authority does not provide for the award of advances for the execution of the The Ordering Party permits the possibility of submitting partial tenders (the order is divided into parts), with each Contractor being able to submit a tender for up to one part of the order (only for one part of the order). The deadline for completion of the order is 12 months, the execution of the order must be started not earlier than 1 June 2022. Thus, the planned deadline for completion of the basic contract the Contracting Authority provides from 01.06.2022 until 31.05.2023. The contract under the option ends at the completion date of the basic contract.
