Description:
Delivery of computer sets necessary for the modernization of stationary computer laboratories of the Faculty of Chemistry of the University of Gdańsk

The subject of the contract is the delivery of computer sets necessary for the modernization of stationary computer laboratories of the Faculty of Chemistry of the University of Gdańsk.

1. Common Procurement Vocabulary (CPV) classification code: 30213300-8 (desktop).

2. The subject of the contract is the supply of computer sets necessary for the modernization of stationary computer laboratories of the Faculty of Chemistry of the University of Gdańsk, hereinafter referred to as "the equipment".

3. A detailed description of the subject matter of the contract is set out in Appendix 6 to the Terms of Reference – Description of the subject matter of the contract.

4. The Contracting Authority allows for the possibility of submitting an equivalent offer.

1) Standards:

a) The standards indicated in the Description of the subject of the contract (Appendix No. 6 to the Terms of Reference) are only exemplary - in each case it specifies the class of the product being the subject of the contract and serves to determine the standard, and does not indicate a specific product or manufacturer. The original nomenclature or symbolism has been given in order to correctly define the subject of the contract.

b) Equivalence shall be understood as the Contractors ensuring that the offered equipment meets the standards not worse than those described by the Contracting Authority in the Description of the subject of the contract (Appendix No. 6 to the Terms of Reference)

10(a), (b), (c) and 11(d) of Table 1.

(c) The Contracting Authority shall recognise as equivalent standards to be drawn up by an independent body which are based on transparency, voluntariness, impartiality, efficiency, credibility, consistency and consensus at national and European level. The application must correspond in its type and scope to the objectives set out in the reference to those indicated by the Contracting Authority.

d) It is the Contractor's responsibility to demonstrate equivalence, i.e. to meet the requirements set out by the Contracting Authority in the Terms of Reference. The Contractor is obliged to indicate in the Offer Form (Appendix No. 1 to the Terms of Reference) the proposed equivalent standards.

e) The Contracting Authority shall not reject the Contractor's bid, provided that the Contractor proves in the offer, in particular by means of the evidence in question, that the proposed solutions

meet the requirements set out in the description of the subject matter of the contract to an equivalent extent (Article 101(5) of the Public Procurement Law).

5. After concluding the contract, the Contracting Authority provides for applying for a 0% VAT rate pursuant to Article 83(14)(1) of the Value Added Tax Act of 11 March 2004 (i.e. Journal of Laws of 2023, item 1570, as amended).
