Description:
Successive provision of post-warranty inspection, repair, maintenance, calibration (adjustment) and calibration of devices for testing alcohol content in exhaled air

1. The subject of the contract is the successive provision of post-warranty inspection, repair, maintenance, calibration (adjustment) and calibration of devices for testing alcohol content in exhaled air type ALCOSENSOR IV (IV CM) and AWAT A. 2.0. for the Provincial Police Headquarters in Łódź, units of the Łódź garrison, the Department in Łódź of the Police Internal Affairs Bureau and the Management Board in Łódź of the Central Bureau of Investigation of the Police.

2. The Contracting Authority shall first examine and evaluate the tenders and then make the qualification of the contractor whose offer has been highest assessed in the absence of grounds for exclusion and compliance with the conditions for participation in the proceedings (Article 139 (1) uPzp).

3. Pursuant to Article 257(1) of the PPL, the Contracting Authority reserves the right to cancel the proceedings

4. Pursuant to Article 95(1) of the Public Procurement Law, the Contractor/subcontractor undertakes to employ under an employment contract during the contract performance period

Task 1

1. A detailed description of the terms of the contract is set out in the contract template – Annex 11 to the SWZ.

2. The quantities and type of assortment are specified in the Assortment and Price Form - Annex 2.1-2.2 to the SWZ respectively to the part in accordance with point 6.

3.The Contractor undertakes to:

1) have appropriate technical facilities, knowledge and practice in carrying out technical inspections, maintenance, repairs, calibration and calibration of devices referred to in point 5.1 of the SWZ;

2) carrying out technical inspections (adjustment), maintenance, repairs, calibration and calibration in a reliable, timely manner, consistent with the current level of technical knowledge and technical and operational requirements of the manufacturer and equipment manuals;

3) performing inspections and inspections of the technical condition as well as performing calibration and calibration in accordance with applicable regulations and recommendations of the equipment manufacturer.

4. Calibration must be carried out in the Measurement Laboratory accredited by the Polish Centre for Accreditation – the Contractor will be obliged to attach to the offer a confirmation of the above-mentioned accreditation.

5. The Ordering Party reserves the right to change the number of devices and the number of services provided, specified in Annex 2.1 and 2.2 – assortment and price form, according to the task number.

6. The performance of services will be confirmed each time in the service protocol.

7. The Contractor undertakes to collect the devices from the Ordering Party and deliver them after the service to the same address, at its own expense and risk on working days between 8.30 and 15.00. The address of receipt of the device will be indicated in the order each time (list of places – Annex 3 to the contract template).

8. The Contractor undertakes to perform the service within max. 15 working days from the date of receipt of the device by the Contractor. Working days are understood as days from Monday to Friday excluding Saturday and Sunday. Shortening the deadline for the contract is one of the criteria for evaluating offers.

9. In exceptional situations, resulting from reasons beyond the control of the Contractor, it is permissible to extend the deadline for the provision of the service, which requires the Contractor to send an application with the actual justification and description of the situation and to receive written acceptance / consent of the Ordering Party by the Contractor.

10. The actual number and type of services will depend on the needs of the Ordering Party and its budget resources. In the case of ordering services of a lower value than specified in § 8 section 1 of the model contract, the Contractor shall not be entitled to any claims in this respect against the Contracting Authority.

11. The Contractor assumes full responsibility for damage to the equipment caused by improper performance of the service. In the event of damage, the Contractor is obliged to reimburse the costs of repairing the device, and if necessary – an expert opinion commissioned by the Ordering Party.

12. The Contractor undertakes to perform repairs using only brand new spare parts.

13. The performance of the technical inspection will be confirmed by an appropriate entry in the "instrument book" and a service protocol delivered to the Ordering Party, and the calibration / calibration certificate.

14. The Contractor shall each time provide together with the device (for each device separately) a calibration certificate issued by the calibration point, the Office of Measures or the Accredited Laboratory.

15. If the Ordering Party reports such a need, the Contractor undertakes to provide a free copy of the device manual.

Disposal of all used parts and consumables in accordance with applicable law is the responsibility of the Contractor. The cost of this service has been included in the prices specified in the assortment and price form.

WARRANTY: for a minimum period of 6 months - for spare parts (to be indicated in the offer form); for a minimum period of 30 days - for repairs performed (to be indicated in the offer form

Exercise 2
