The subject of the contract is to act as a Substitute Investor for the implementation of the investment entitled: "Construction of an office building with land development and full technical infrastructure on the property at 5 Kazimierza Dłuskiego Street for the seat of the Tax Office in Otwock". A detailed description of the subject of the contract, the scope and conditions of its implementation is specified in: the description of the subject of the contract constituting Annex No. 2 to the SWZ and the draft provisions of the contract – model contract, constituting Annex No. 5 to the SWZ. The Contracting Authority:a) does not allow the submission of variant bids and in the form of electronic catalogues, b) provides for the possibility of awarding the contract in accordance with Article 214(1)(7) of the Public Procurement Law c) provides for the use of the so-called reverse procedure in accordance with Article 139 of the Public Procurement Law, d) pursuant to Article 257 of the Public Procurement Law, provides for the possibility of invalidating the procedure if the public funds that the Contracting Authority intended to allocate to finance the entire contract, were not granted to him.

The subject of the contract is to perform the function of a Substitute Investor for the implementation of the investment entitled: "Construction of an office building with land development and full technical infrastructure on the property at 5 Kazimierza Dłuskiego Street for the seat of the Tax Office in Otwock". A detailed description of the subject of the contract, the scope and conditions of its implementation is specified in: the description of the subject of the contract constituting Annex No. 2 to the SWZ and the draft provisions of the contract – model contract, constituting Annex 5 to the SWZ. 2. The Contracting Authority shall: a) not allow the submission of variant bids and in the form of electronic catalogues, b) provides for the use of the so-called reverse procedure in accordance with Article 139 of the Public Procurement Law, d) in accordance with Article 257 of the Public Procurement Law, provides for the possibility of cancelling the procedure if the public funds that the Contracting Authority intended to allocate to finance the entire contract have not been granted to it.3. The contracting authority does not divide this contract into lots, because such division would threaten excessive technical difficulties and excessive costs of performing the contract. The need to coordinate the activities of the various economic operators performing the different lots of the contract could seriously jeopardise the proper, timely and efficient performance of the contract.4. Subcontractors: all information regarding subcontracting has been included by the Contracting Authority in the model contract constituting Annex 5 to the SWZ. The Contracting Authority requires that the Contractor in the statement - the Single European Procurement Document (ESPD) indicates to the Contracting Authority whether it will perform the contract on its own or whether it intends to entrust the Subcontractors with the performance of part of the contract.

6. Contracts for similar services - the Contracting Authority provides for the possibility of awarding a contract pursuant to Article 214(1)(7) of the PPL within 3 years from the date of award of the basic contract. This contract will consist in the repetition of a similar service which is the subject of this basic contract, representing no more than 50 % of the value of the basic contract. This contract will be executed if funds are obtained for its implementation and will be awarded under the same conditions as the basic contract.

7. Pursuant to § 11 clause 1 of the model contract, the Contractor is obliged to have civil liability insurance for damage caused in connection with the conducted business activity, including the provision of services subject to this contract, for a guarantee sum of not less than PLN 5,000,000.00.
