The subject of the contract are services consisting in renting and servicing portable sanitary equipment in places supervised by the Infrastructure Service Section administered by 4 WOG in Gliwice, in order to secure sanitary tasks carried out in 2023

1. The subject of the contract are services consisting in renting and servicing portable sanitary devices in places supervised by the Infrastructure Service Section administered by 4 WOG in Gliwice, in order to secure sanitary tasks carried out in 2023

A detailed description of the item of the order shall include the following annexes

2. The Contracting Authority shall not allow the submission of variants, and

in the form of electronic catalogs.

3. The Contracting Authority does not provide for the possibility of awarding contracts referred to in Article 214(1)(7) of the PPL Act.

4. The contracting authority requires the contractor or subcontractor, on the basis of an employment contract, to employ persons performing activities related to the performance of the contract, indicated

in the description of the subject of the contract, i.e. in particular works related to the installation, acceptance, transport and servicing of sanitary facilities. Employees must be employed under an employment contract within the meaning of the provisions of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2020, item 1320, as amended) at least for the duration of the contract.

The requirement does not apply to, m.in. natural persons conducting business activity, incumbent members of the management or supervisory bodies of the contractor, partners in a general or partnership company, incumbent members of the management or supervisory bodies of the contractor, partners of a general partnership or partnership, to the extent that they will personally perform works for the Contracting Authority or the Contractor.

The method of verifying the employment of these persons, the power of the Contracting Authority to control the fulfillment of the requirements for the employment of those persons and the sanctions for failure to comply with these requirements are described in the proposed provisions of the contract (Annex 4 to the SWZ).
