Provision of the service of protection of persons and property carried out by Specialist Armed Protection Formations (SUFO) in a round-the-clock shift system for the economic subdivisions of the Military Unit
The proceedings are conducted in accordance with the provisions of the Act of 11 September 2019 Public Procurement Law (Journal of Laws of 2022, item 1710, as amended) in a restricted tender procedure in accordance with Article 410(1) PPL. Contract qualified for contracts in the fields of defence and security. The CONTRACTING AUTHORITY does not provide for a limit on the number of economic operators it will invite to submit tenders. The CONTRACTING AUTHORITY will invite all CONTRACTORS whose requests to participate in the proceedings will not be subject to rejection to submit tenders.
1. The subject of the contract is the provision of personal and property protection services provided by Specialized Armed Protection Formations (SUFO) in a round-the-clock shift system for the economic subdivisions of Military Unit No. 6021.

2. A detailed description of the subject of the contract is specified in: Annexes No. 12 and No. 13 to the SWZ, i.e.: Description of the subject of the contract and Draft provisions of the contract.
3. The CONTRACTING AUTHORITY shall not allow partial bids. Reasons for not dividing the contract into lots: The military complex KW-0044 is one compact area that does not have a geodetic or physical division between the deployed military units and internal cells. Dividing the contract into lots will result in the fact that pursuant to section 0303 point 8 letter a "Instruction on the protection of military facilities and escorted property – DU-3.14.3(A)" Commanders of military units are obliged to provide rooms for the purpose of performing protective tasks. In the absence of such rooms, it would generate additional costs related to the construction or adaptation of facilities or rooms to the regulations in force in the Ministry of National Defense regarding the presence of protective forces in them.
4. The CONTRACTING ENTITY requires the CONTRACTOR to employ on the basis of an employment relationship persons performing activities indicated by the CONTRACTING ENTITY in the scope of contract performance: physical protection of persons and property, if the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2022, item 1510, as amended). The method of verifying the employment of these persons and the rights of the CONTRACTING ENTITY to control compliance by the CONTRACTOR with the requirements related to the employment of these persons and sanctions for failure to meet these requirements is included in Annex 10 to the SWZ, i.e.: Draft provisions of the contract.
[On-site inspection requirements]
5. Due to the specificity of the subject of the contract, the CONTRACTING AUTHORITY requires the submission of a bid after the CONTRACTOR has completed the on-site inspection.
Remark! The CONTRACTING AUTHORITY shall reject the CONTRACTOR's bid if: [...] "was submitted without an on-site visit or without checking the documents necessary for the performance of the contract available on site from the CONTRACTING AUTHORITY, if the CONTRACTING AUTHORITY required it in the procurement documents". Legal basis: Art. 226 sec. 1 point 18) of the PPL
6. The on-site inspection may be carried out on working days from Monday to Friday from 8.00 a.m. to 2.00 p.m. The on-site inspection may be attended by CONTRACTORS or authorized employees of the CONTRACTOR. Before the on-site visit, the CONTRACTOR should send to the CONTRACTING AUTHORITY a list of participants with the data contained in Appendix 2 within 14 days before the planned on-site visit. The CONTRACTING ENTITY shall confirm the possibility of conducting an on-site inspection within the requested time limit in writing to the e-mail address indicated by the CONTRACTOR.
Rules of entry to the military complex:Entrance to the complex K-0044 will be through the Pass Office, where bidders will receive passes marked "GUEST";
tenderers should have with them:
- identity card;
- security clearance to the minimum clause "restricted";
- training in the protection of classified information";
- current ID of the security guard.
7. The CONTRACTING AUTHORITY does not allow the submission of variant bids.
8. The CONTRACTING AUTHORITY does not provide for granting advances for the performance of the contract.
9. The CONTRACTING AUTHORITY does not provide for an electronic auction.
10. The CONTRACTING AUTHORITY does not intend to establish a dynamic purchasing system.
11. The CONTRACTING AUTHORITY does not provide for convening a meeting of CONTRACTORS.
12. The CUSTOMER does not envisage the conclusion of a framework agreement.
13. The CONTRACTING AUTHORITY does not reserve the right to apply for the award of a contract only by CONTRACTORS referred to in Article 94(1) of the PPL, i.e. social cooperatives and other CONTRACTORS whose main objective or main purpose of the activities of their organisationally separated units that will perform the contract is the social and professional integration of persons socially marginalized.
