The subject of the contract is the purchase of electricity for the needs of the Entities belonging to the Purchasing Group (established by the Association of Municipalities of the Wisłoka River Basin on the basis of Agreements on the joint conduct of public procurement procedures for the purchase of electricity). 3.2. The purchase of electricity does not include the provision of an electricity distribution service. 3.3. The organisational units listed in point 3.4 shall separately conclude contracts resulting from this public procurement procedure under the open tender procedure.
The purchase of electricity will take place under the conditions specified in the Energy Law Act of 10 April 1997 (Journal of Laws of 2023, item 295, as amended), executive regulations to this Act, and in particular the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the power system (Journal of Laws of 2007 No. 93, item 623 with later dates. as amended), the tariff for electricity distribution services of the relevant Distribution System Operator (DSO Tariff), the Distribution Network Operation and Operation Manual (IRiESD) and generally applicable legal regulations. 3.6. Annex 4 to the SWZ describes a summary statement of electricity demand by entities and tariffs. The energy consumption values indicated in Annex 4 to the SWZ were adopted to calculate the estimated value of the contract, which does not reflect the actual use of electricity during the term of the contract and in no case can be the basis for any claims on the part of the Contractor. The actual settlements will take place on the basis of current indications of metering and settlement systems for the supply of electricity in accordance with the Contractor's offer. 3.8. Estimated demand for electricity in the contractual period, i.e. from 01.07.2023. to 31.12.2025r. for all entities included in the Purchasing Group is approx. 33 140 MWh. 3.9. As part of the performance of this contract, the contracting authority provides for a right of option under Art. 441(1) of the Public Procurement Law. By the right of option, the Ordering Party understands the possibilities of performing the contract to a wider extent than provided in these proceedings. The right of option is a right of the Ordering Party which may or may not be exercised in the performance of this contract. The right of option will consist in increasing the volume of electricity ordered to 10% of the volume indicated in Annex 4 to the SWZ, by placing an appropriate order by a given Contracting Authority. 3.10. These entities do not conduct the activity of reselling electricity. 3.11. Detailed requirements are presented in Annex 4 to the SWZ: 3.12. It is expected that the number of energy consumption points during the contract execution period may increase (max 10% of the basic volume), e.g. by newly built street lighting, lighting of squares and illuminations of buildings and walls, as well as newly built or acquired facilities or buildings, etc. The Contractor will be obliged to supply energy to the facilities specified in Annex 4 to the SWZ and to new consumption points that will be built and connected to the grid. Lists of new collection points will be submitted to the contractor electronically or by traditional mail. The demand for electricity may also increase if electricity consumption increases. Increasing the number of energy consumption points will be possible on the basis of an annex signed on both sides to the contract for the sale of electricity concluded with the Contractor. 3.13. Increasing collection points or changing the tariff group is possible only within tariff groups that have been included in the SWZ and priced in the Contractor's Offer Form. It is stipulated that the number of energy consumption points during the contract execution period may be reduced in the event of, for example, sale or fire of a building, removal of lighting, etc. Lists of liquidated collection points will be forwarded to the contractor electronically or by traditional mail. Reduction of energy consumption points will be possible on the basis of an annex signed on both sides to the contract for the sale of electricity concluded with the Contractor.
