1. The contracting authorities described in Chapter I of the SWZ shall jointly conduct a public procurement procedure (Article 38 of the Public Procurement Law). The contracting authority authorized to conduct the procedure and select the most advantageous offer (part 1, part 2 and part 3 of the contract) is the Municipality of the City of Brodnica. Contracts will be awarded (signed by contracts for the supply of electricity) by the contracting authorities described in Chapter XVIII.
2. The subject of the contract is the supply of electricity in the period from 01.01.2023. until 31.12.2023
up to 1 065 collection points (PPE) with a total estimated volume (+/-10%) of 18 482.94 MWh, of which:
1) For premises and facilities – tariff groups C, G, R (Part 1 of the contract) – 9 756,07 MWh – a detailed list of PPE is attached as Annex 1a to the SWZ
2) For premises and facilities – tariff group B (Part 2 of the contract) – 7 431.64 MWh – a detailed list of PPE is attached as Annex 1b to the SWZ
3) For the purposes of road lighting (Part 3 of the contract) – 1 295.23 MWh – a detailed list of PPE is attached as Annex 1c of the SWZ.
Electricity supply to premises and facilities — tariff groups C, G, R1. Number of measuring systems accounting for consumed electricity 816 pcs.
2. A detailed description of the pre-emptive points (PPE) of the Contracting Party included in Annex No 1a to the SWZ.
3. Estimated electricity consumption during the term of the contract – 9 756,07 MWh, of which:
Zone I 5 855,37 MWh
Zone II 3 491,70 MWh
Strefa III 409,00 MWh
The above data is indicative. The Contractor should take into account possible fluctuations in electricity consumption at a level of +/ -10%).
4. Deliveries will take place from 01.01.2023. until 31.12.2023, unless different dates of commencement of deliveries to 3 facilities of the Municipality of Nowe Miasto Lubawskie (items 26-28), details of delivery dates in relation to individual collection points are described in Annex 1a to SWZ column "Delivery period".
5. The Ordering Party of the Book Commune has the status of the Producer for:
a) Item No. 25 (number 590243892020676742) in Annex 1a to the SWZ, the ordering party from March 2022 has an installation of photovoltaic panels with a capacity of 3.75 kWp. The contracting authority provides for the conclusion with the contractor whose offer will be selected of a contract for the resale and balancing of energy generated in a RES micro-installation and not used (about 0.5 MWh per year), which will be valid for the entire delivery period.
b) Item No. 26 (number 590243892020874278) in Annex 1a to the SWZ, the ordering party from March 2022 has an installation of photovoltaic panels with a capacity of 20.25 kWp. The contracting authority provides for the conclusion with the contractor whose offer will be selected of a contract for the resale and balancing of energy generated in a RES micro-installation and not used (about 1 MWh per year), which will be valid for the entire delivery period.
6. The Ordering Party of the Municipality of Zbiczno has the status of the Manufacturer: - item No. 29 (PPE number 590243895024017351) in Annex No. 1a, the ordering party from January 2022 has an installation of photovoltaic panels with a capacity of 39.6 kWp. The contracting authority provides for the conclusion with the contractor whose offer will be selected of a contract for the resale and balancing of energy generated in a RES micro-installation and not used (about 0.5 MWh per year), which will be valid for the entire delivery period.
7. Electricity supply contracts currently in force will expire or terminate with effect on the date preceding the scheduled date of the start of supply (the “Supply Period” column). The obligation to terminate contracts is on the side of the contracting parties (recipients).

5. The Ordering Party Miejskie Przedsiębiorstwo Wodociągów i Kanalizacji Sp. z o.o. in Brodnica will have the status of the Producer:
1) Item No. 2 (number 590243895024252752) in Annex No. 1b to the SWZ, ordering party from 30.06.2023. (planned date of connection) will have an installation of photovoltaic panels with a capacity of 200.00 kWp. The contracting authority, after commissioning the installation, provides for the conclusion with the contractor whose offer will be selected of a contract for the resale and balancing of energy generated in the RES micro-installation and not used (about 1.0 MWh per year), which will be valid until 31.12.2023.
2) Item No. 3 (number 590243895023992185) in Annex No. 1b to the SWZ, ordering from 30.06.2023. (planned date of connection) will have an installation of photovoltaic panels with a capacity of 200.00 kWp. The contracting authority, after commissioning the installation, provides for the conclusion with the contractor whose offer will be selected of a contract for the resale and balancing of energy generated in the RES micro-installation and not used (about 1.0 MWh per year), which will be valid until 31.12.2023.
3) Item No. 4 (number 590243895024507173) in Annex No. 1b to the SWZ, ordering party from 30.08.2023. (planned date of connection) will have an installation of photovoltaic panels with a capacity of 160.00 kWp. The contracting authority, after commissioning the installation, envisages concluding with the contractor whose offer will be selected a contract for the resale and balancing of energy generated in the RES micro-installation and not used (about 0.5 MWh per year), which will be valid until 31.12.2023.
4) Item No. 6 (number 590243895024506091) in Annex No. 1b to the SWZ, ordering party from 30.09.2023. (planned date of connection) will have an installation of photovoltaic panels with a capacity of 40.00 kWp. The contracting authority, after commissioning the installation, envisages concluding with the contractor whose offer will be selected a contract for the resale and balancing of energy generated in the RES micro-installation and not used (about 0.5 MWh per year), which will be valid until 31.12.2023.
6. The measuring systems shall be adapted to the procedure of changing the seller.
7. Existing contracts for the supply of electricity will expire with effect from the day preceding the planned date of commencement of deliveries (column "Delivery period").
8. For all PPE, the change of seller will take place once again.
