1. The subject of the order is: “Diesel supply” depending on the ambient temperature (period) respectively:
• summer,
• transient,
• winter,
whose method of delivery and quality will meet the requirements set out in the currently binding provisions in particular in the Act of 25.08.2006 on the system for monitoring and controlling fuel quality (i.e. Journal of Laws of 2021 item 133 as amended) and in the Regulation of the Minister of Economy of 9 .10.2015 on quality requirements for liquid fuels (Journal of Laws, item 1680 as amended) and meeting PN-EN 590+A 1:2017-06 /Ap2.
2. Total size of basic order: 1558m3, specified in actual temperature conditions.
2.1 Option law: the largest possible range of the order taking into account the right of options is 2181m3
2.2 Option rights: reduce to 20% of the amount of basic order in case of unforeseen circumstances and in exceptional cases having force majeure up to 50%.

whose method of delivery and quality will meet the requirements set out in the currently binding provisions in particular in the Act of 25 August 2006 on the system for monitoring and controlling fuel quality (i.e. Journal of Laws of 2021, item 133 as amended) and in the Regulation of the Minister of Economy with on 9 October 2015 on the quality requirements for liquid fuels (Journal of Laws, item 1680, as amended) and meeting the requirements of the Polish standard PN-EN 590+A 1:2017-06 /Ap2.
a) Total size of the basic order: 1558m3 ON, specified in actual temperature conditions.
b) The Contracting Authority reserves the option to purchase fuel in quantities deviating from the specified quantities, while maintaining options, depending on the actual needs of MPK MPGK, STBS, ZZO and PEC.
c) Option Law: The Ordering Party provides for the possibility of exercising the right option consisting in increasing the basic scope of the contract, i.e. the quantity of supply of diesel fuel under the processed contract. The largest possible range of the order taking into account the right of options is 2181m3 ON. The Selected Contractor will allow the Contractor to purchase additional quantities of fuel on the same terms as supplies covered by the basic order.
d) Option Law: The Ordering Party provides for the possibility of exercising the right of the option of reducing up to 20% of the quantity of the basic order in the event of unforeseen circumstances and in exceptional cases having a force majeure nature, such as: epidemic, pandemic, war, decrease in the amount of diesel bought to 50%.
e) The right of options is the right of the Contracting Party which he may, but does not have to exercise in the implementation of this Agreement. In the event that the Contractor fails to exercise the right of the Contractor's option for that reason, no compensation claim shall be entitled.
f) If the right of options is exercised, the change of contract or the conclusion of a separate agreement will not be required. The Contracting Authority shall submit an appropriate statement on this circumstance.
