The subject of the order is delivery (within the meaning of Article 2 item 2 of the PPL) 600 m
The contract includes 2 types of orders, i.e. services or supplies, due to the fact that the main subject of the contract in terms of costs is the supply of diesel oil, provisions for delivery apply to its award.
In order to precisely specify the subject of the order, the Employer divides its description into 2 segments:
a) launch of a maintenance-free diesel oil intake system with the function of managing deliveries and refueling, together with handing over for use during the execution of the order 2 above-ground double-shell tanks with a capacity of 5,000 liters each;
b) gradual delivery of diesel oil up to 24 months from the day of signing the contract as part of a maintenance-free diesel oil intake system with the function of managing deliveries and refueling.

As part of this segment of the contract, the Contractor will be obliged to put into service 2 double-shell tanks with a capacity of 5,000 liters, equipped with distributors with an unattended diesel oil intake system, driver and operator management as well as machine and means of transport operation.
1) Launch of a maintenance-free diesel oil intake system with the function of managing deliveries and refueling.
The existing state provides for the functioning of two filling points that will be used by Agencja Komunalna Spółka z oo in Brzeszcze: at ul. Kościelna 7 and at ul. Graniczna 48 (average annual fuel consumption in both locations: approx. 80,000 l / year and 164,000 l / year respectively). Their task will be to take fuels from road tankers into a storage tank, store fuels and release them through a tank with a distributor to the tanks of motor vehicles. As part of this segment of the contract, the Contractor will also be required to provide and install diesel oil distributors and connect it to two double-shell 5,000-liter aboveground ground tanks located at both Employer's bases. The Employer envisages providing vehicle identifiers and driver identifiers / cards in accordance with the system requirements. Cards must provide recognition in the driver and vehicle system. The Employer specifies that it provides for the system to include 55 vehicles and 50 drivers.
2) Successive diesel supply:
Diesel supply parameters:
a) diesel oil should meet the parameters specified in the PN-EN 590 Standard, valid as at the date of submission of the offer, and the Regulation of the Minister of Economy on quality requirements for liquid fuels of October 9, 2015 (i.e. Journal of Laws of 2015, item 1680). The Employer provides for the supply of standard oil throughout the entire contract period, with the proviso that in the winter (December 1 - February 28) reserves the right to order diesel with improved low-temperature properties (so-called arctic), whose availability in the aforementioned winter period the Contractor should guarantee. The above reservation does not create an obligation for the Ordering Party to order arctic oil, the above provision is only to secure the departure of vehicles for winter road maintenance or collection of waste in the event of extremely low temperatures. The rule remains that standard diesel oil will be delivered during the contract period (subject to the provisions of Annex 6a to the ToR in fine regarding changes in the type of oil supplied during the contract). Diesel fuel should characterize the parameters indicated in Annexes 6a and 6b (technical conditions of diesel fuel according to the above standards). The above conditions apply to each diesel supply during the contract period. Other conditions of OPZ are found in the ToR.
The issues of participation in the proceedings of entities acting jointly are regulated in Chapter 10 Terms of Reference, subcontracting - ch. 9 of the SETC.

If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, at the request of the Employer, he shall submit documents in accordance with the ordinance of the Minister of Development of 26.7.2016 on the types of documents that the Employer may request from the Contractor in post. for an order (Journal of Laws 2016 item 1126 as amended) - details in chapter 13 point 4 of the Terms of Reference.
