1.The subject of the contract is the supply of electricity in the period from 01.07.2023. until 31.12.2023r. - up to 563 consumption points (PPE) with a total estimated volume of 2 277.03 MWh, The estimated demand for electricity was determined on the basis of previous consumption.

2.Electricity quality standards are described in the Act of the European Parliament and in the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the power system (Journal of Laws of 2007 No. 93, item 623, as amended) amended by the Regulation of the Minister of Climate and Environment of 27 September 2022 amending the regulation on detailed conditions for the operation of the power system (Journal of Laws of 2022, item 2007). The rules for shaping and calculating tariffs and settlements in electricity trading are specified in the Regulation of the Minister of Climate and Environment of 29.11.2022 (Journal of Laws of 2022, item 2505, as amended).

1. Details of electricity consumption are described in Annex 1a/1b/1c to the SWZ Lists of consumption points:

1) Appendix No. 1a - premises and objects of tariff groups C, G

2) Annex 1b - premises and facilities tariff group B

3) Annex 1c - road lighting

2. Annex 1a/1b/1c to the SWZ indicates to which customers (and to what extent) the maximum price will apply.

3. The Contractor, based on the Power of Attorney granted, will be obliged to report the contract on its own behalf and on behalf of the ordering party to the competent DSO in accordance with applicable regulations and to represent it before the DSO in the process of changing the seller.

4. Applicable tax periods:

Tariff Group B, C2x — 1 m-c

Tariff group C1x, G, R — 2 m ce

5. Measurement systems with tariff group B are tailored to the seller's change procedure.

6. Electricity deliveries are carried out on the basis of forward sales contracts, their term expires on the day preceding the planned date of commencement of deliveries (as described in Annex 1a/1b/1c to the SWZ column "Delivery period").

7. In Annex 1a/1b/1c in the column "Change of seller" indicates in relation to which PPE will change the seller for the first time, and in relation to which again.

1) In the case of collection points where sales and distribution contracts have already been separated (subsequent change of seller), the contracting authority (recipients) have distribution agreements concluded for an indefinite period.

2) In the case of collection points for which the change of seller will take place for the first time, the contractor will be authorized by the contracting authority to submit applications for the conclusion of distribution agreements for an indefinite period.

8.Contracting Authority Municipality of Gardeja:

1) will have the status of a Producer - Item No. 57 (PPE number 590243823003478725) in Annex 1a to the SWZ - the contracting authority plans to install photovoltaic panels with a capacity of 17.1 kWh in April 2023. The contracting authority plans to conclude with the contractor whose bid will be selected, a contract for the resale and balancing of energy generated in RES micro-installations and not used (about 0.5 MWh per year), which will be valid throughout the delivery period.

2) has the status of a Producer - Item No. 1 (PPE number 590243823003685413) in Annex 1b to the SWZ - the ordering party from November 2022 has an installation of photovoltaic panels with a capacity of 40.00 kWh. The planned amount of energy produced - 40 MWh. The contracting authority plans to conclude with the contractor whose offer will be selected, a contract for the resale and balancing of energy generated in RES micro-installations and not used (about 0.5 MWh per year), which will be valid throughout the delivery period. The contracting authority will agree to conclude contracts for the resale of energy on the model used by the contractor.

9. The contracting authorities shall designate Energa-Obrót SA with its registered office in Gdańsk as a reserve supplier.

10. The condition for starting electricity supplies within the indicated period (for individual PPEs) is the positive completion of the change of supplier procedure.

11. In Annex 1a/1b/1c to the SWZ, in the column "Buyer / Recipient (address for sending invoices)" the address for sending the invoice is indicated. Data on issuing and delivering invoices will be included in the Electricity Supply Agreement / Annex to the Agreement.
