The subject of the contract is the delivery of 18 (eighteen) model-identical vehicles adapted to conduct state examinations in the field of category B driving license, with identical technical parameters, color and identical equipment, for the Provincial Road Traffic Center in Szczecin. All vehicles must meet the technical conditions applicable in the Polish, legal requirements appropriate to the purpose of the vehicles and the requirements contained in the Detailed Description of the Subject of the Contract (SOPZ), constituting Appendix No. 1 to the SWZ.
1. The subject of the contract is the delivery of 18 (eighteen) model vehicles adapted to conduct state examinations in the field of category B driving license, with identical technical parameters, color and identical equipment, for the Provincial Road Traffic Center in Szczecin. All vehicles must meet the technical conditions applicable in the Polish, legal requirements appropriate to the purpose of the vehicles and the requirements contained in the Detailed Description of the Subject of the Contract (SOPZ), constituting Appendix No. 1 to the SWZ. 2. The delivery includes brand new cars, produced in 2023. or 2022 meeting all the minimum requirements described in Annex 1 to the SWZ. All cars must be from the same year of manufacture. 3. Place of delivery: The Contractor is obliged to deliver vehicles at its own expense and risk to the ordering party's headquarters – Golisza 10B, 71-682 Szczecin. 4. Equivalent tenders: Whenever in the SWZ and annexes, the subject of the contract was specified by indicating the trademarks, patents or origin, source or specific process that characterizes the product or services provided by a particular contractor, the intention of the contracting authority was to provide an example of "type", i.e. to specify the minimum quality parameters and functional characteristics of the product, material or technology; in such a case, the contracting authority shall allow equivalent tenders to be submitted and it must be assumed that such an indication is accompanied by the words 'or equivalent'. The offered equivalent solutions (devices, equipment or materials) will have parameters no worse than those specified by the Ordering Party. By the term "minimum quality parameters and functional characteristics" the Ordering Party understands the requirements for materials or equipment contained in generally available sources, catalogs, websites of various manufacturers. Possible manipulation of sample names, characters, etc. is only exemplary in order to clarify the expectations of the Ordering Party, while maintaining the neutrality of the contract description. If the Contracting Authority refers to standards, European technical assessments, approvals, technical specifications and technical reference systems (certificates) relating to the subject of the contract, solutions equivalent to those described by the ordering party shall be allowed. The contracting authority, in the scope of standards referred to in the documentation, indicates that the required standard is a requirement "at least" and allows the subject of the contract with higher standards, equivalent to those described. A contractor who invokes solutions equivalent to those described by the contracting authority is obliged to indicate that the supplies, services or works offered by him meet the requirements specified by the contracting authority. 5. The Contracting Authority does not divide the contract into lots for the following reasons: 1) The lack of division does not affect competition; 2) The division of the contract into parts will not be effective: 18 identical vehicles are ordered. 3) The Contractor should be fully responsible for the performance of the subject of the contract, because its components are closely related to each other and dividing them could lead to preventing the Ordering Party from enforcing contractual obligations from the Contractor during the warranty period. Thus, the Ordering Party does not allow the submission of partial offers.
