The Contracting Authority may cancel the procurement procedure pursuant to Article 257 of the Act if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted. Settlement will be made on the basis of actually completed successive deliveries in accordance with the needs of the Ordering Party, according to the gross unit prices offered, subject to § 9 of the proposed provisions of the agreement. The maximum value of the contract for each task will be the amount that the Contracting Authority intends to allocate to finance a given task, given before the tenders are opened.
