The Contracting Authority may cancel the procurement procedure pursuant to Article 257 of the Act if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted. Settlement will be made on the basis of actually completed successive deliveries in accordance with the needs of the Ordering Party, according to the gross unit prices offered, subject to § 9 of the proposed provisions of the agreement. The maximum value of the contract for each task will be the amount that the Contracting Authority intends to allocate to finance a given task, given before the tenders are opened. The Contracting Authority allows for the transfer of funds between tasks under the contract concluded with one Contractor.

Non-manufacturer consumables should list all types of devices with which the inks and toners are compatible. The Contractor has the right to offer an equivalent assortment in the form of substitutes for task No. 1, 2, 3, 4. Equivalent products are understood as substitutes characterized by full compatibility with the devices in which they are to be used as consumables, comparable, i.e. the same or better print quality, drying speed, colors, capacity, efficiency and have analogous functions, e.g. information about the state of cartridge wear. Within the scope of task no. 5, the contractor submits a bid only for original consumables manufactured by the manufacturer of printing devices (Kyocera, Triumph Adler, HP).
