TUM Maintenance Fire Extinguishing Systems

The subject of the contract is the maintenance of fire extinguishing systems.

Campus Garching

The object of the contract is the maintenance of fire extinguishing systems for the TUM Campus in Garching. Details are set out in the terms of reference, which are attached to the tender documents as Appendix 1. The Contractor must also observe the overarching FM operating concept, which is attached to the tender documents as Annex 2. A map of the TUM Campus in Garching is attached to the tender documents as Appendix 3a (Lot 1).

Weihenstephan campus

The subject of the contract is the maintenance of fire extinguishing systems for the TUM Campus Weihenstephan.

Details are set out in the terms of reference, which are attached to the tender documents as Appendix 1. The Contractor must also observe the overarching FM operating concept, which is attached to the tender documents as Annex 2.

The service description (Appendix 1) and the operating concept (Appendix 2) describe a 3-level model consisting of the client (1st level), the service provider commissioned by the client for object coordination (hereinafter referred to as "OK") (2nd level) and the FM service providers, to which the contractor also belongs (3rd level). Reference is also made to the OC in the contract (Annex 5).

It is hereby bindingly pointed out that the OC is not active on the Weihenstephan campus (lot 2). This means that the tender documents in Lot 2 are to be understood as meaning that the OK of the AG is in principle there. This means that in Lot 2, the activities of the OC described in the tender documents are in principle carried out by the client. Services provided by the Contractor such as reporting obligations to the OC (e.g. in the event of unplanned incidents, cf. Section 2.7 5) of the service description (Appendix 1), in the case of defects detected in connection with maintenance, cf. Clause 3.2 13) of the service description (Appendix 1), etc.) and coordination with the OC are thus to be provided in Lot 2 by the Contractor (only) vis-à-vis the Client. There are therefore only two levels in Lot 2: the AG and the FM service providers.

In addition to this principle, the following passages of the tender documents in Lot 2 are to be understood as follows:

- Section 3.4 of the service description (Appendix 1) ("Fault management"), Clause 2.2 of the operating concept (Appendix 2) ("Reporting chain for fault messages"):

There is no helpdesk in Lot 2 that accepts fault reports within the listed times. The Contractor, the users and third parties report faults directly to the Client within the times listed therein.

- Section 3.9 of the service description (Appendix 1) ("Reporting"):

The services in connection with the reporting for the operation of the building are the responsibility of the client. The Contractor shall support these services of the Client by preparing reports on all contractual services of the Contractor and the regular reporting of these services to the Client. The development of optimization concepts is the responsibility of the client himself.

A map of the TUM Campus in Weihenstephan is attached to the tender documents as Appendix 3b (Lot 2).
